1.0 INTRODUCTION

By letter dated December 24, 1996, with an addendum dated January 31, 1997, the Connecticut Yankee Atomic Power Company (the licensee) submitted a request for changes to the Haddam Neck Plant Technical Specifications (TS). The request would change the Administrative Controls section of the TS as needed to implement revised management responsibilities and titles to reflect the permanently shut down status of plant. The staff considered the material in both of the licensee's submittals in deriving the no significant hazards consideration determination.

2.0 EVALUATION Under the requirements of 10 CFR 50.82, the licensee submitted a letter dated December 5,1996, that informed the NRC that the plant had permanently ceased power operations and that all nuclear fuel had been removed from the reactor vessel. As a consequence of these actions, which initiated the decommissioning process, the licensee requested changes to the following TS

that would reflect the new plant status:

TS 6.1 RESPONSIBILITY TS 6.2 ORGANIZATIO4 TS 6.5 REVIEW AND AUDIT (Except for TS 6.5.2, that is discussed below)

TS 6.6 REPORTABLE EVENT ACTION TS 6.7 SAFETY LIMIT VIOLATION TS 6.8 PROCEDURES AND PROGRAMS, and TS 6.13 RADIOLOGICAL EFFLUENT MONITORING AND OFFSITE DOSE CALCULATION MANUAL The position and title of Executive Vice President Nuclear was replaced with the new position and title of Executive Vice President and Chief Nuclear Officer. The responsibility for overall corporate facility operations was transferred from the Vice President - Haddam Neck to the Executive Vice President and Chief Nuclear Officer. The position and title of Vice President

. that of Plant Manager at other facilities. The Unit Director will be I responsible for overall unit safe operation and will report to the Executive l Vice President and Chief Nuclear Officer. The proposed changes to these seven l TS sections serve to delete the old positions and replace them with the redesignated positions. Based on a review of the proposed changes, the staff i

concludes that this is an admini:,trative change and there is no decrease in '

management responsibility or authority due to these changes; therefore, the changes are acceptable. .

1 TS 6.5.2 NUCLEAR SAFETY ASSESSMENT BOARD (NSAB) 1 Previous to this change request, the Haddam Neck Plant shared the Nuclear Safety Assessment Soard (NSAB) with the Millstone facility which is still an i operating facility. The safety issues, resources and expertise required for a

, permanently shutdown plant are different from those of an operating facility.

An independent board would be established by this proposed TS change that l would be responsible for safe operation of the Haddam Neck Plant only and l would be completely separate from Millstone operations. The revised TS retain '

the NSAB as an independent oversight review and audit group with the required expertise in eight areas of plant operations. The size of the new NSAB and the qualification requirements of its members and meeting schedule are unchanged. Based on the abo *e, the staff concludes that the changes to the llSAB TS are acceptable. In TS 6.5.2.7 B DIT PROGRAM RESPONSIBILITIES, the

' licensee proposed changing the name of the Quality Assessment Services Department-to Nuclear Oversight Organization. As the audit programs in thew TS remain unchanged, this change in title is acceptable.

3.0 STATE CONSULTATION

In accordance with the Comission's regulations, the Connecticut State  !

official was notified of the proposed issuance of the amendment. The State official had no comments.

4.0 ENVIRONMENTAL CONSIDERATION

The amendment changes the administrative procedures and requirements of the license. Accordingly, the amendment meets the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(10). Pursuant to 10 CFR 51.22(b) no environmental impact statement or environmental assessment need be prepared in connection with the issuance of the amendment.

5.0 _GQRCLUSION The Comission has concluded, based ca the considerations discussed above, that: (1) there is reasonable assurance that the health and safety of the public will not be en:hngered by operat?on in the proposed manner, (2) such activities will be conducted in compliance with the' Comission's regulations, and (3) the issuance of the amendment will not be inimical to the comon defense and security or to the health and safety of the public.
