i l DETAILS OF INVESTIGATION i Purpose Of Investigation This investigation was initiated after completion of Case A4-85-005, wherein the Kansas Gas and Electric (KG&E) Quality First (Q1) investigative program at 1 Wolf Creek was reviewed for completeness and adequacy. This investigation was selected for evaluation by the Office of Investigation (01) with the concur-I rence of the Region IV Regional Administrator after a review of Q1 files i revealed that the alleger's concerns of drug use by employees may not have been properly investigated and the Q1 investigation appeared to have been closed prematurely. It is to be noted that 01's efforts were directed toward determining the adequacy of the Q1 investigation rather than conducting an independent investigation of the alleged drug use.

2 Background

During May 1985, an 01 and Region IV review of the Wolf Creek Q1 program of KG&E was conducted as reported in Case A4-85-005. The suspected improper dispositioning by Q1 of an allegation of drug use by quality engineering (QE) personnel was identified. The Region IV Regional Administrator was advised of the results of the Q1 investigation and concurred with the initiation of an 0I investigation due to the appearance of undeveloped leads and questionable l findings on the part of Q1. Briefing Of OI Director On August 26, 1985, Ben B. HAYES, Director of 01, was apprised of the results of this investigation to date. HAYES directed this investigation to be closed after the Region IV Regional Administrater was apprised of the investigation to date so that the safety significance of the allegations and the information could be technically evaluated by the NRC Region IV staff. Contact With Regional Administrator On August 29, 1985, the Region IV Regional Administrator was advised of the results of this investigation to date by Richard K. Herr, Director 01, Region 1 IV. The Regional Administrator stated the safety significance of the informa-tion developed in this investigation could not be judged until a technical J evaluation of the work completed by the individuals in question was conducted. t The Regional Administrator advised that the Region IV technical staff would pursue this matter with KG&E for safety significance and impact. The Regional Administrator was advised that no further OI participation { regarding this investigation'is anticipated unless further investigation is requested subsequent to the technical review. A memo documenting this conver-i sation is enclosed as EXHIBIT 5. 3 iJ! Willingness / Intent Section j KG&E management prematurely directed the termination of this Q1 investigation (EXHIBIT 4). The expressed rationale was that the reported drug use was not under their jurisdiction and, therefore, further involvement by Q1 was not deemed ) necessary by KG&E (EXHIBITS 1 and 4). j Agent's Conclusions ) ) Based on the information available in the Q1 files, it is 01's belief that an investigative plan as a minimum should have included the interviews of , and ., all of whom worked on site at i Wolf Creek. Further inquiries could have been made to determine the location I of the drug use and subsequent appropriate interviews of the homeowner. neighbors, co-workers, and supervisors could have been conducted. The Q1 investigation failed to adequately address the above described logical steps and interviews required to accomplish a complete and thorough investigation. Based on the weight of evidence, it is the reporting investigator's conclusion that the drug investigaton was prematurely and improperly terminated by Q1 at the direction of KG&E management. i Status Of Investigation No 'further OI participation in the assessment of the Q1 drug investigation is anticipated unless further assistance is requested by the Regional Admini-strator subsequent to the Region IV technical staff review. Supplemental Information During the course of this investigation, interviews were conducted by OI with former investigators of the KG&E Q1 program. These Q1 investigators expressed concern over the KG&E management of the Q1 program in that matters were perceived to be covered up and, therefore, pertinent information was not reaching the NRC. By separate correspondence, Region IV was advised by this office of the concerns raised in the statements attached to this report. Region IV was asked to determine if the concerns were of sufficient magnitude and impact to warrant the initiation of an O! investigation into the Q1 program itself. .h; J Case No. 4-85-012 13 l
