l June 12, 1985 DETAIL OF ASSIST TO INSPECTION Purpose of Assist to Inspection Pursuant to a May 24, 1985 request by the U.S. Nuclear Regulatory Commission Region IV Regional Administrator, Office of Investigations Field Office, Region IV Senior Investigator D. D. DRISKILL and Investigator M. EMERSON were assigned to assist in a Region IV review effort of Wolf Cree 9 Generating Station (WCGS) Quality First (Q1) inspection / investigation records for adequacy in the investigation of concerns provided to Q1 concerning WCGS. The NRC Q1 4

Review Group, directed by RICHARD DENISE, Director, Division of Reactor Safety and Projects, Region IV consisted of NRC representatives from Region IV, NRR, I&E and 0I. The planned Q1 file review effort was divided into a review for adequacy of technical matters investigated by Q1 and a separate review of Q1 investigations conducted concerning allegations of wrongdoing at WCGS. The NRC review effort was scheduled for May 27-31, 1985.

Details of Investigative Activities On May 27, 1985, the Q1 Manager, CHARLES SNYDER, provided the NRC Q1 Review Group with a computerized listing of all Q1 concerns investigated since the Q1 inception in early 1984. The computer listing divides the Q1 investigation case numbers into two separate groups; the KG&E telephone hotline (for i

allegations) into a sequential listing prefaced by the designation " HOT" and another sequential listing of investigation file numbers prefaced by the designation "QCI" (Quality Concern Investigations). Those investigation file numbers prefaced QCI were initiated upon Q1 receipt of allegations / concerns expressed by " walk-ins" or via termination / exit interviews of personnel l

employed at WCGS. A review of the computer printout disclosed 66 Q1 I

investigations (broken down into 151 concerns) were initiated between March 20, 1984 and May 9, 1985 as a result of allegations / concerns obtained via the KG&E telephonic hotline. The printout additionally listed 205 QCI investigations initiated, between March 12, 1984 and April 29, 1985. The data contained on the printout of Q1 investigations included a " categories / concern code" for each concern reported (i.e., code A03-harrassment/ intimidation, code A08-falsification

of records, code A17-drugs). SNYDER provided a key to these codes which is appended as Exhibit (1).

It was determined that the 01 investigators would review the Q1 investigative. concerns which were considered to be associated with matters generally investigated by NRC 01. The Q1 printout listed 85 concerns identified above as codes A03, A08 and A17. Twenty technical j

concerns investigated by Q1 were also selected for review by 01 subsequent to j

review of a Q1 summary list (Exhibit 2). Seven additional Q1 investigations i

were reviewed by 01 at the request of the technical review group.

n The OI participation in this review of WCGS Q1 records was limited strictly to a review and evaluation of the Q1 investigative file's contents. It is helpful to refer to to the December 21, 1984 W. J. WARD to BEN B. HAYES memo entitled 01 EVALUATION OF KANSAS GAS AND ELECTRIC INVESTIGATIVE PROGRAM, (Exhibit 3).

This memo provides very informative background relative to the Q1 program and j

its interrelationships with other WCGS and KG&E departmental entities. This j

memo also contains a number of accurate observations and conclusions concerning j

the Q1 operational shortcomings and programmatic deficiencies. These j

observations have been further corroborated by the findings of this separate j

evaluation of the Q1 case files.

j The May 27-31, 1985 review of Q1 investigative files performed the 01 investigators, involved a total of 112 concerns / allegations which were contained in 75 Q1 investigative case files. The OI review and evaluation

found approximately 2/3 (77 oi 112) of the Q1 investigations to be inadequate in that they do not support the conclusion reached by the Q1 investigator. The inadequacy of these investigations appears to be primarily the result of two

{

fundamental shortcomings in the Q1 program itself.

It appears Q1 personnel lack formal investigative experience and training. Also the Q1 program lacks l

the necessary program requirements to ensure that objective, professional and j

complete investigations are performed. The following observations by reporting i

and participating investigators were made relative to Q1 investigations j

reviewed, each of which result from the aforementioned programmatic shortcomings:

1.

Q1 interviews of allegers were almost always inadequate. The initial interviews, based on reviews of the interview notes, which were contained in most case files, do not reflect that the alleger was questioned in adequate detail concerning the allegation / concern necessary to perform a meaningful investigation. The traditional

investigative "who, what, when, why and where" were not obtained.

This defect in many of the investigations appears to have been the responsible factor for the inadequacy of Q1 investigations and the t

resultant lack of credibility in their conclusions.

Q1 investigations appeared to rely on the Q1 perception of " impact on safety" as a basis for closing many investigations prior to the I

resolution of the allegation.

It was noted, in some cases, that the investigator did not recognize the full extent of the potential for j

safety significance of the allegation. Most allegations of drug abuse did not reflect consideration of the possible adverse effect to j

hardware or records which could result from onsite drug use.

Furthermore, the' perceived " impact on safety" was used, in some j

cases, as a basis to find allegations " unsubstantiated" when in fact ample evidence was obtained to corroborate the allegations / concerns.

It was also noted that the statement of "no impact on safety" was often used as a basis to close investigations prior to adequate ll resolution.

As reported in Exhibit (3), page 6, the Q1 " reports seldom provide the detailed documentation to support their conclusions that we expect in 01 reports of investigation." The Q1 reports generally do not provide the dates investigative efforts were performed nor do they. consistently identify the sources from which the investigative I

information was obtained. Basically, they provide just the j

information the investigator used in reaching his/her conclusion.

It was noted, and is of concern to the OI investigators, that the facts I

contained in the narratives of the reports are often times insufficient to reach a credible conclusion. A critique of many of the Q1 reports give the impression that a conclusion was reached prior to or early in the investigative process and information was reported which was believed to be a basis for supporting that conclusion. Participating investigator noted his occasional frustration with some reports which contained " unexplained leaps in logic to reach a conclusion."

j The OI review disclosed several Q1 investigative files which contain evidence which cast significant doubt on the integrity of the Q1 program.

In one j

instance an alleger reported having been subjected to harassment and i

intimidation by supervisors (Q1 report QCI 84-79T, allegation 2). The report does not reflect a detailed explanation regarding the harassment and intimidation and the investigative report reflects only the interviews of two supervisors. The supervisor allegedly responsible for the harassment and intimidation denied the allegation and refused to discuss the matter further.

A second supervisor described the alleger as having problems with absenteeism and tardiness. The Q1 records review reportedly disclosed the alleger's performance evaluations were good and reflected no excessive absenteeism or tardiness. Q1 did not make any effort to resolve the apparent discrepant testimony of the one supervisor. An 01 review of the notes relating to the initial interview of the alleger disclosed the alleger had provided detailed 1

information relating to four instances of harassment, intimidation and threats which were not only absent in the Q1 report but contradict the Q1 characterization of the actual allegation. This contradiction is viewed as a serious misstatement of the allegation in the Q1 report. The review of another Q1 file (QCI 84-94) disclosed interview notes wherein a female employee described incidents of being physically and sexually harassed by co-workers and a supervisor. The alleger also reported having discussed the situation with a member of management who told her "to quit if she couldn't handle the normal construction atmosphere." The Q1 investigation minimized the nature of the harassaent but did find the alleged behavior to have occurred. The Q1 report states "the practice (the physical and sexual harassment).... has been stopped. as a form of in-house horseplay by management." The Q1 report states "intimication and harassment, as defined by (10 CFR) 50.7 and (Energy Reorganization Act, Section) 210 has not been proven" therefore, the allegation is " unsubstantiated".

It was found that in many cases, Q1 reports do not accurately reflect the true nature of the respective allegations.

The 01 review of Q1 investigative file QCI 84-14 (allegation 19) provides evidence of KG&E management influencing the conclusion.of an investigation without regard for the investigator's findings. This investigation appears to

3, f3 s.i have been thorough and objective in its initial substantiation of the harassment and intimidation allegation, as documented in a confidential memo by 1

the manager of Q1. The file also contains a confidential memo, from the KG&E legal department to the KG&E WCGS QA manager, stating the allegation was not substantiated as defined by 29 CFR Part 24 (the D0L statute regarding discrimination). Subsequently the Q1 final report was prepared stating the 1

allegation of harassment and intimidation was not substantiated "as defined by 29 CFR Part 24. This appears to represent an effort by KG&E management to influence the conclusion of a Q1 investigation. The investigation focused on

" harassment and intimidation" which is not the subject addressed in 29 CFR 24.

Although KG&E may be defining harassment and intimidation utilizing the 29 CFR 24 definition of discrimination, this is not the criteria used by NRC to substantiate an incident of alleged harassment and intimidation.

It appears that the KG&E legal department's interjection of a legal opinion on this matter persuaded Q1 to disregard its original conclusion in this matter.

It was additionally noted that several other Q1 investigations of harassment and intimidation were also found " unsubstantiated" by Q1 who quoted 29 CFR 24 and the Energy Reorganization Act Section 210.

The 01 review of Q1 case files also disclosed a number of instances wherein Q1 listed the allegation on their initial investigative plan and did not perform any investigation. Some other cases did not list in the plan all allegations of wrongdoing which were made.

An OI review / critique sheet was prepared for each Q1 case file reviewed. These i

review sheets identified the Q1 case file number, the allegation title (s), a brief synopsis of the Q1 investigation performed and an 01 evaluation of Q1 findings / disposition. These review sheets are appended, in sequential Q1 case file number order as Exhibit (4). Amplification of these individual review / critique sheets will be provided upon an appropriate request.

On May 28, 1985 reporting investigator obtained from a confidential source 55 manila folders each containing documents purportedly copied from original WCGS Q1 investigation files. The confidential source also provided one additional bundle of documents allegedly copied from a Q1 investigative file.

Between May 29 and May 31, 1985 L. E. ELLERSHAW, Reactor' Inspector, NRC Region IV performed a review and comparison of these documents utilizing the original Q1 investigative case files. This review disclosed that the respective WCGS Q1 files were more complete and comprehensive than the files obtained from the source. Additionally ELLERSHAW reported having found no evidence of alterations or missing documents in the original Q1 investigative files. ELLERSHAW's memo concerning this review is appended as Exhibit (5).

I have information that I wish to provide in confidence to the U. S. Nuclear Regulatory Commission (NRC).

I request an express pledge of confidentiality as a condition of providing this'information to the NRC.

I will not provide this information voluntarily to the NRC without such confidentiality being extended to me.

- i It is my understanding, consistent with its legal obligations, the NRC, by agreeing to this confidentiality, will adhere to the following conditions:

(1) The NRC will not identify me by name or personal identifier in any NRC initiated document, conversation, or communication released to the public which relates directly to the information provided by me.

I understand the term "public release" to encompass any distribution outside of the NRC with the j

exception of other public agencies which may require this information in j

futherance of their responsibilities under law or public trust.

(2) The NRC will disclose my identity within the NRC only to the extent required for the conduct of NRC related activities.

In such cases, the basis for granting this promise of confidentiality and any other relevant facts will be communicated to the authority ordering the disclosure in an effort to maintain my confidentiality.

If this effort proves unsuccessful, a representative of the NRC will attempt to inform me of any such action before disclosing my identity.
