This investigation was initiated on August 25, 1998, by the Nuclear Regulatory _ Commission (NRC), Office of Investigations

-(OI), Region IV (RIV),-to determine if a Bechtel Construction, Inc. (BCI) contract painter, who worked at Southern California ,

Edison's-(SCE) . San-Onofre Nuclear Generating Station (SONGS), was

-the subject of employment discrimination by his supervisor for reporting concern,s to the Nuclear Safety-Concerns Program.

Purcose of Investication LThis investigation.was initiated on August 25, 1998, by the-Nuclear Regulatory Commission (NRC), Office of Investigations (OI), Region IV (RIV),;to determine if David A. WETTSTEAD, a

Backaround--

On August 16, 1998, Jim SLOAN, NRC' Senior Resident Inspector (SRI).at SCE's San _Onofre Nuclear Generating. Station, was-co'tacted n by WETTSTEAD who reported to the Nuclear Safety Concerns Program (NSCP) at SONGS concerns regarding the quality of coatings on the condenser waterbox which was performed about a year ago. According to WETTSTEAD, NSCP's investigation of his

-complaint revealed that he was c. 3d by Scott PARADA, General Foreman, BC1. PARADA was dic lined { verbally.

counseled-Exhibit 2) as a' result of NStr s investigation into the complaint. In August 1998, WETTSTEAD.was rated and resultantly l ranked lower on the " Forced Ranking" employee list for layoffs.

could go to the NRC and file a complaint. WETTSTEAD said PARADA I also announced that morning he was designating Ricardo CASTRO as the critical component checker for the day shift crew, and Chuck McKENZIE, as the critical component checker for the night crew staff. WETTSTEAD related that he was the night shift's designated critical component checker, and he was " devastated" ,

when he heard PARADA had designated McKENZIE as the night shift's  !

critical component checker. He said he did not have anything l against McKENZIE, but he said he felt embarrassed and degraded that PARADA had chosen McKENZIE rather than him (WETTSTEAD). He said PARADA elected McKENZIE just to get back at him [WETTSTEAD]

and felt PARADA was retaliating against him because he reported safety concerns to the NSCP and the NRC.

l Another event which led WETTSTEAD to believe he was being I discriminated against by PARADA was when the night shift crew was penalized by not being allowed to work overtime on a weekend.

According to WETTSTEAD, the day shift crew worked overtime on a heat exchanger which had malfunctioned during the night; so when the day shift crew arrived the next day, it was the day shift who l Worked on it. WETTSTEAD said he approached PARADA and complained I about not being given the overtime, but PARADA told him that if l they (night shift crew] did not like it, they could find a job elsewhere. WETTSTEAD said PARADA was trying to get back at him for reporting safety concerns, but this time PARADA punished the entire night shift crew.

During April 1998, WETTSTEAD said he noticed and felt he was given the " cold shoulder" treatment by several of his fellow employees. WETTSTEAD said he believed it was due to his unfavorable relationship with PARADA. He said a lot of people who used to talked to him, did not speak to him anymore.

On another occasion, WETTSTEAD indicated he and YOUNG were having a conversation when Vince BROWN, Foreman, Painters, BCI, approached them, and he [BRONN) began to say something to YOUNG about work, but halfway during the conversation, BROWN stopped and said, "something stinks around here." WETTSTEAD said BROWN did not finish what he was saying: however, he (BROWN] just walked away. WETTSTEAD said he considered that incident an example of a hostile work environment and retaliatory act against him as a result of reporting safety concerns.

WETTSTEAD said he and M were likely to be the "two guys" that the SONGS employee was referring to because both he (WETTSTEAD) and 6 reported safety concerns to the NSCP and the NRC. WETTSTEAD said he was certain the " guys upstairs" wanted to get rid of him and M ZUBER, who heard this in March 1998, did not disclose the SONGS employee's identity to WETTSTEAD, but indicated he (ZUBER] would tell the NRC if he was asked.

WETTSTEAD further, advised he talked to Barry CLARK, BCI Site Manager, and apprised him of the recent events which had occurred involving him and PARADA. WETTSTEAD said he told CLARK that he believed these events were purposely motivated by PARADA to I retaliate against him (WETTSTEAD] for bringing up safety concerns. According to WETTSTEAD, CLARK tried to get him and PARADA to come to terms and reconcile any differences between them, but he (WETTSTEAD] refused. When asked if anyone from BCI or SONGS' management personnel had discouraged him (WETTSTEAD]

from reporting safety concerns to the NSCP or NRC, he said "no."

WETTSTEAD believed BCI management was unfair with the force ranking of employees, for example, he said BCI laid off hard working painters like 6 and others. He said the fact that he reported his safety concerns to the NSCP protected him from being terminated earlier. Asked if he knew of any other painters who were ranked GRENEEEE that were also treated unfairly he said, "two definitely that should have been a 19 or 20 and were knocked down to probably a 14, enough to get them thrown out of the plant." He further advised, "the unfair thing is .it's not so much me as it is the other guys. I can't stand to see --

you know -- other guys get screwed. That's the unfairness."

AGENT'S NOTE: During the conduct of this investigation, OI:RIV learned that METTSTEAD received a score of 4Nl but remained employed until October 23, 1998. WETTSTEAD, along with approximately 19 other painters were laid off in the l third of a series of staggered lay offs resulting from the l August 19, 1998, force ranking (10 1EBNP painters were ranked 18; 3 were ranked 19; and 2 were ranked 20]

SONGS since September 1996. DeMARSICO stated he was not laid off as a result of the August 18, 1998, force ranking, explaining that he believed it was his positive attitude toward work that elevated him above his coworkers who had been laid off. He considered the force ranking process a fair procedure and felt i that his initiative and productivity were greater than a majority of the other painters, although in his opinion, WETTSTEAD was a good painter. DeMARSICO denied having any knowledge that WETTSTEAD's termination was the result of retaliation. He concluded by saying that he has never been instructed by anyone not to report concerns to management and that he would feel comfortable in doing so. Interview of Joseph COLEMAN (Exhibit 16) COLEMAN, Painter, BCI, was interviewed by OI:RIV on November 17, 1998, and indicated he has been employed by BCI at SONGS since June 1992 and has served as a foreman on different occasions. In regard to the force ranking procedure, COLEMAN felt that more latitude should be given to the foreman in deciding who was to be selected for lay off. He opined that he was not a victim of the latest series of lay-offs because of his extensive experience in the painting field. He said although he has never had an opportunity to rank WETTSTEAD or supervise him, his understanding was that he [WETTSTEAD) was a very knowledgeable painter, but had some problems in the past with management personnel. COLEMAt1 further indicated that some of the painters who were not laid off  ! exhibited more initiative and were not as complacent. COLEMAN l claimed he was unaware of any information indicating that WETTSTEAD's lay off was a result of retaliation. Interview of Garv ZUBER (Exhibit 17) ZUBER was interviewed by OI:RIV on November 18, 1998, and advised he has been employed at various times by BCI at SONGS since 1977. l During his employment with BCI, he had functioned as a journeyman painter and a foreman. ZUBER stated he was familiar with the force ranking system having ranked numerous painters under his supervision in the past. He was aware that upon submitting his rankings to the general foreman, they [ general foremen] had the authority to change the ranking based on their evaluation. that reason, HERNANDEZ stated WETTSTEAD was not laid off as a result of employment discrimination by management for reporting safety concerns to the NSCP and the NRC. Interview of Miouel PODRIGUEZ (Exhibit 19) RODRIGUEZ, Project Superintendent, BCI, was interviewed by OI:RIV on November 19, 1998, and advised he has been employed with BCI since 1969. He explained that as the project superintendent, he supervised every department and readily admitted that he was not personally familiar with the painters. In a situation where he wanted some information regarding the painters, RODRIGUEZ acknowledged that he went to Bill TURN 30W, Maintenance Superintendent, BCI, and if he was not available, then to either  ! MORIARITY or PARADA. Regarding the force ranking process, RODRIGUEZ felt it was a fair program and claimed he was unaware of any utilization of the program for retaliation against an individual. He offered that during the actual force ranking l process, the foremen did the initial ranking which was then forwarded to the general foremen for their review. Upon j completion of their [ general foreman's] review, the forms were then forwarded to the superintendents who insured compliance with the program and the confidentiality of the form. Finally, with administrative assistance, it was formatted into a consolidated report (Exhibit 12) The finalized ranking sheet was then retained in CLARK's office, and the original work forms were shredded. RODRIGUEZ admitted that in a case where he observed a change in the original ranking by a general foreman, he did not question the general foreman about it, explaining that he trusted the general foremen. He added that within the force ranking procedure, 25 percent of the painters were placed in the top . ranking, 50 percent in the middle, and 25 percent in the lower ranking. This guidance was relayed to the foremen prior to each force ranking in an effort to have the initial scores conform with the goals. Interview of Milliam TURNBOM (Exhibit 20) TURNBOW was interviewed by OI:RIV on November 19, 1998, and advised he has been the maintenance superintendent. BCI, at SONGS since April 1998. TURNBOM explained the force ranking procedure

Interview of Terry HAYSE (Exhibit 21) HAYSE was interviewed by OI:RIV on November 19, 1998, and advised he has been employed with BCI at SONGS since 1994 during which time he had served as a journeyman painter and foreman. When asked about his familiarity with WETTSTEAD, he [HAYSE] said he did not know WETTSTEAD well because he [WETTSTEAD] worked on night shifts and he [HAYSE] worked days, but he thought WETTSTEAD was an average and easy to get along with type of person, based on the 1 week he worked with WETTSTEAD. HAYSE said he did not believe that WETTSTEAD or any other painter were victims of the lay off because of retaliation against them by management. Interview of Kio NELSON (Exhibit 22) NELSON was interviewed by OI:RIV on November 19, 1998, and advised he has worked for BCI since February 1990 serving both as a journeyman painter and foreman. NELSON confirmed he knew WETTSTEAD and described him as an average to above average painter. NELSON was unaware of any animosity between WETTSTEAD and PARADA. In conclusion.
