Seidle, Chief, RC&E5 Branch ~ SUB CT: ALLEGATIONS REGARDING SOUTH TEXAS PROJECT ON 50-498; 50-499 On August 23, 1978, I received a telephone call frem Mr. Dan Swayzey, a Brown & Root QC Lead Insoector-Civil at STP, who had been terminated by his ccmpany on August 22, 1978, for alleged misconduct. Mr. Swayzey requesked a meeting with the NRC to discuss alleged QC-Civil problems at the STP. He stated that he had specific examples of break i down in the QA/QC program that comprcmised the quality of plant construc.- tien in safety related areas. He also stated that he was very upset atcp his recent termination by Brown & Rcot and,was giving serious thought to going to the press. He said he lived in Port Lavaca, Texas (512 552-5075) and would be available for interview the evening of August 23. ACCELERATED QUALITY ASSURANCE INSPECTION - SOUTH TEXAS CONSTRUCTION SITE l ~ the Mid Term Quality Assurance Inspection As we agreed on June 15, 1979, for the South Texas Construction Site will be performed within the next several weeks 'to be completed within 30 days from this date. We also agreed that the inspection will be performed by the presently assigned Principal Inspector, the Resident Inspector who will soon be assigned l and a Headquarters representative (possibly a PAT member). The inspection is to be particularly oriented toward assessment of quality assurance program imolementation effectiveness. Attention should be directed toward the quality assurance program implementation, whether r the quality assurance staff has sufficient independence and freedom, whether there are any irregularites in record keeping, whether finished l work meets requirements, whether welders and other craftsmen are properly qualified, whether work in progress meets requirements. The above is not meant to restrict the activities of the inspection team. I The intent of performing this inspection is to provide a basis for de-termining whether the sum of the allegations that have been made regarding effectiveness of the quality assurance program at the site has substance. Criterion V of 10CFR50, Appendix B, requires that activities affecting quality be accomplished in accordance with written instructions, procedures or drawings. PDM accomplished this require:cnt, as applied to auditor qualifications, by compliance to specific procedures written for this purpose. These procedures are maintained by the PDM Division QA Manager and are available for ir. formation upon request. It is not a requirement that this informa-tion be stated in the QA. Manual and it is POM's pre-ference to maintain separate procedures for audi:or qualification requirements. 3. QA Manuals r.urber 67 and 150 have had the additienal documents removed. Again, a full audit of applicable sec-tions was performed. All of these audits were per-formed within 10 months of commencement of work at the South Texas Project Site by PDM. Section 13.0 of the PDM QA Manual requiring annual audits has been fulfilled. 2. In that the PDM QA Manual is a Corporate Manual, all documentation is not maintained at the South Texas Project Site, however, copies of the men-tiened corrective action statements signed by QA Management have been sent to the South Texas Site and are available for review. 3. a. The audi: results are maintained at the Corpor' ate headquarters, heuever, copies of these results showing they have been reviewed by responsible managemen: have been sent to the Site and are available for review. b. Per QA Manual, paragraph 13.S, "The Division QA Manager shall initiate re-audits as required to assure correction of deficiencies". The re-sults shall be reported to the Division Chief Engineer. Audit 77-202 was case of such audit, being deemed as required by the Division QA Manager, and with results reported at the Divi-sion Sngineer. In the cases of c:her audits, the Division QA Manager has no: deemed re-audits as necessary. This is in corpliance with Section 13.0 of the QA Manual. c. Since 1977, PDM Drawing Con:r:1 has been a recurring deficiency as noted in,several audi s. This problem was caused because cf difficul:ies in coordinating the PCM Drawing Con:r:1 System with the Brown 6 Root Drawing Control System. Another deficiency of similar nature identified in 197S led to both groups using the Ercur. 5 Roo: system and classifying the PDM system as " info rmation only". Another drawing control deficiency as noted in audi: 79-203 was in errof'and is apparent after reading the.Audi: Deficiency Report.

Failure to Delineate Organi:stional Change in PDM QA Manual Corrective Action The new Manual has been submitted to Brown G Root for approval on November 1, 1979, which will correct the noted deficiency in the organi:ation chart. Recurrence Control This crgani:ational change was made approximately two weeks prior to the NRC Audit and their Manual had not been revised to reflect this change. A major rewrite of their Manual was to be made in the near fu:ure and they had held back waiting for the new revision to make the necessary changes. FDM has been reminded to be more timely in the future when changes to their Manual are necessary. D. Failure to Destroy or Stame a Deleted Procedure Corrective Action The holder of the Brown 6 Root, South Texas Procedures Manual (ST-QAP) number 29, had chosen to retain a de-leted procedure, number ST-QAP-S.12, as a personal reference document. This was permissible by ST-QAP-2.2 providing the holder stamps the precedure as " VOID" or " SUPERSEDED". The manual holder had inadvertently failed to stamp the procedure as required by ST-QAP-2.2. Your response and the additional infor=ation furnished to the RRI were reviewed. As a result of our review, we have deter =ined that your responses to itens A.1, A.2, 3.1 and B.3 were inadequate as follows: Item A.l. QA Manual Supple =ents Your response to item A.1 failed to address the finding that Section 12.0, " Manual Revision and Distribution," did not describe require =ents to integrate supplements into the Pittsburg-Des Moines (PDM) Corporate Tield QA Manual. Item A.2, Auditor Qualification Your response to item A.2 failed to identify the specific auditor qualifi-cation require =ents that are maintained by the PDM Division QA Manager. It should be pointed out that, during the inspection, neither licensee personnel nor the PDM QA Manager provided specific infor=ation to the II inspector concerning PDM QA Manual requirements related to auditor quali-fication. This audit was first presented to the RAI on December 10, 1979, during the meeting to discuss your response. Item B.3. Review of Audit Results Your response 3.3.c indicated that audit 79-203 erroneously reported a drawing control deficiency, but f ailed to snntion that this information was not provided to the RRI during the inspection. You are requested to provide, within 20 days of the receipt of this letter, (1) additional infor=ation related to items A.1 and A.2 above; (2) a description of measures that vill be taken to assure that information of the type that was later supplied relative to items A.2, 3.1 and 3.3 is made available to the IE inspectors during the conduct of inspections; and (3) dates when full co=pliance vill be achieved for all ite=s described in the Notice of Violation. Crossman recalved a telephone call at his home from a p former Brown & Root amployee who reported alleged QC 1rregularicles at S!?. On the even1=g of May 2,1979, a talephone call to the alleger was made by W. A. Cross =an and W. G. Hubacek for the purpose of securing additional i=- for=ation cocearning the allegation. Dur1=g the telephone conversation, the following information was provided by the alleger: The allegar has,made an approximataly 200 page sworn deposition to a Brown & Root accorney in connection with a suit against Brown & Root resulting from ter=1sation of his employment at STP. The allager stated that his deposition contains references to QC 1rregularities that vara observed during his employment at STP and he askad if the NRC hearing board would be interested in obtain1=g his deposities by subpoena. The allager stated that his deposition described what he raferred to as "a continuous card game" in the NDE lab and other locations by the QC Civil Department during an approximate 6-8 month period beginning in Mid-1977. He stated that the QC inspectors would leave the game only to sign concreta pour cards when requested by radio and return to the game without performi=g further inspection. Es stated that no inspections were perfor=ad for approx 1=ately four months because of threats.
