i Attorney Frank Digiammarino, U.S. DQ7, Southern District of l

Georgia, was telephonically contacted by J. Y. Vorse and advised l

of the merits of the above willful act by the two IAC technicians 1

at Plant Vogtle.

Mr. Digiammarino declined any criminal i

prosecution based on the availability of other punitive actions j

by the NRC.

OI plans no other activity regarding this matter.

ALLEGED FAILURE BY GEORGIA POWER SENIOR MANAGERS TO PROVIDE COMPLETE AND ACCURATE SAFEGUARDS INFORMATION TO THE NRC l

Enclosed for your information is the synopsis of the Nuclear l

Regulatory Commission's (NRC)- Office of Investigations (OI) completed report regarding the alleged withholding of information by Georgia Power Company (GPC) management during an enforcement conference on May 22, 1990, and the alleged attempts by GPC management to impede reporting requirements pertaining to safeguards events.

1 The investigation did not substantiate that pertinent information l

was withheld from the NRC at the time of the enforcement conference on May 22, 1990, or that GPC management impeded,the reporting of safeguards events.

Based on the results of the investigation and our sdbsequent review, we have found no violation of NRC requirements.

We plan no further action with regard to this-matter.

On December 26, 1990, the Regional Administrator, U.S. Nuclear i

Regulatory Commission (NRC), Region II, requested the Office of Investigations (OI) to conduct an investigation to determine if 1

the management of Georgia Power company (GPC), the licensee for l

the Vogtle Electric Generating Plant, Naynesboro, Georgia, had j

withheld pertinent information from the NRC staff during an j

enforcement conference on May 22, 1990, and if GPC management j

i actively impeded reporting requirements pertaining to safeguards i

events.

I The OI investigative offorts focused on the knowledge, handling, and reporting of safeguards events or issues, some of which were 1

alleged, to include:

(1) the issue of an unsecured Southern l

Company Services (a contract firm) safeguards container in November 1989, (2) the issue of 14 uncontrolled safeguards documents at corporate headquarters, (3) the allegat;,on of l

Inadequate safeguards controls at Bechtel offices, a vendor, (4) the allegation of 150 boxes of uncontrolled safeguards i

documents at difforent locations, and (5) the allegation of 2 boxes of improperly controlled safeguards documents.

During i

the investigation, interviews of pert;,nent individuals were l

performed, and documents and procedures were reviewed.

The OI investigation did not substantiate that pertinent informa-l tion was withheld from the NRC at the time of the enforcement conference on May 22, 1990.

It was also concluded that although the reporting of safeguards events to the NRC was slow in some instances, GPC management did not actively impede the reporting j

process.
