DEMAND FOR INFORMATION The purpose of this letter is to provide you with the enclosed Demand for Information.

In January 1990, NRC Region 11 received information alleging that Vogtle Electric Generating Plant (VEGP) Unit I was. intentionally placed in a con-dition prohibited by Technical Specifications.

In response to that information, the NRC initiated an investigation to determine the facts and circumstances of the allegation..The NRC Office of Investigations completed its investigction on Narch 19, 1991, and concluded that Technical Specification 3.4.1.4.2 was knowingly and willfully violated.

The NRC is concerned that, according to testimony you provided during the j

investigation, you were on shift as Operations Superintendent on Shift on October 12, 1988, and that you were aware that adding chemicals at mid-loop would constitute entry into the actions statement of Technical Specification 3.4.1.4.2.

Additionally, you testified that you were aware that valves 1-1208-U4-176 and 1-1208-04-177 were opened in order to fill the chemical addition pot.

The event in question involved the apparent willful violation of Technical Specification 3.4.1.4.2 in that Unit 1 Reactor Makeup Water Storage Tank valves were opened to facilitate chemical cleaning of the Reactor Coolant System when Technical Specifications required the valves-to be closed and secured in 1

position while the plant was in Mode 5 with reactor coolant loops not filled.

1 In your testimony during the' NRC investigation, you denied violating Technical Specification 3.4'.1.4.2 during the four occasions that the Reactor Makeup Water Storage Tank valves were opened on October 12-13, 1988, and stated you adequ-ately executed the inmediate action-statement by only leaving the valves open for a maximum of five minutes which you claimed constituted compliance with

'The NRC is concerned that you may have intentionally disregarded Technical

viewed as a particularly significant matter because of the position you held at the time of the event. As Operations Superintendent on Shift at the time, it was yetcr responsibility to ensure compliance with Technical Specifications.

-Information provided by you as a result of the Demand for Information, as well as information developed as a result of the investigation, will be used as the basis for c'eciding what NRC actions, if any, are appropriate regarding your l

continued involvement in 10 CFR Part 50 and 10 CFR Part 55 licensed activities.

Upon completion of the evaluation of all appropriate information, the NRC will i
