Docket llo. 50-301 Subiect: PROPOSED IMPOSITIOli OF CIVIL PENALTY - $75,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $75,000 Will be issued on or about December 8, 1992 to the Wisconsin Electric Power Company. This action is based on the inoperability of one train of the safety injection system piping in the recirculation mode due to the presence of foreign material in the piping. This violation, which has been classified at Severity Level III, continued for about a year and was due to inadequate foreign material exclusion controls during a system modification performed during the previous refueling outage. The base civil penalty of $50,000 has been escalated a total of 50 percent with 100 percent escalation for the duration of tho violation and 50 percent mitigation for identification and corrective actions.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:

Mailing of Notice December 8, 1992 Telephone Notification of Licensee December 8, 1992 The State of Wisconsin will be notified.

The licensee has thirty days from the date of the Notice in which to respond. Following 11RC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
