NOTICE OF VIOLATION i

This is to inform the Commission that a Notice of Violation will be issued on l

or about September 5,1996, to an unlicensed individual who formerly worked as a laundry / decontamination technician at the Point Beach Nuclear Plant. The action is based on an investigation conducted by the Office of Investigation.

l which determined that as a prank. the individual improperly disposed of a i

radioactively contaminated particle by taping it to the underside of a survey l

table, rather than disposing of it in accordance with the licensee's l

procedures. Although the action did not overexpose any workers, the l

individual's misconduct did subject his coworkers to some additional dose, and placed the licensee for Point Beach Nuclear Plant. Wisconsin Electric Power l

Company, in violation of NRC license conditions and NRC regulations.

I A Severity Level IV violation is being issued to Wisconsin Electric Power Company, for the individual's failure to follow procedures.

l It should be noted that the individual has not been specifically informed of the enforcement action. The schedule of issuance and notification is:

l Mailing of Notice September 5, 1996 l

Telephone Notification of Licensee September 5. 1996 The State of Wisconsin will be notified.

The individual.is required to the respond to the Notice and document the reasons as to why the NRC should have confidence that he will comply with NRC l

regulatory requirements in the future. After reviewing the individual's response, the NRC will determine whether further NRC enforcement action is j

necessary to ensure his compliance with NRC regulatory requirements.
