HRFA is interested in maintaining the purity of the waters of the Hudsen, its tributaries and the Atlantic coastal waters from pollution by rad $onctive waste materials, excessive heat-ing of water and all other-substances which may endanser the 1;ves of fish, other aquatic life and the ecology of the Hudson

The decision of the Commission in the prasent matter will affect tne fish and acuatic life of the Hudson River, particularly in the Indian Point area, and the Atlantic coastal waters by allow-ing the construction of a power generating plant drawing water i
from and discharging water into the Hudson at Indian Point which, if not properly safeguarded, would allow radioactive i
waste to enter the waters of the. Hudson, and would allow exces-sive discharges of heat and perhaps other substances.
If the plant is so designed as to allow discharges of radioactive 4
water, heat or other substances, they would adversely affect fish and aquatic life in the Hudson,-its tributaries and the Atlantic coastal waters and adversely affect the interest of the HRFA.

Environmental Policy Act which shall include the comments and views of the appropriate Federal, state and local agencies which are authoriced to develop and enforce relevant environ-mental standards, f

Fish are grcat concentrators of certain pollutants through the precaos known as b.iologica] magnificatien, and HRFA would be adversely affrcted if such magnificat ton took place from radioactive wastes i.n the Hudson, its tributaries and the At3 cntic coastal untcts.

Valuable squatic organisms, including fishes,-their l
eggs and larvae, would be subjected to disease, injury or death as the result of the discharge of large volumes of-heated water into the Hudsen by the plant.
HRFA will cite the record of fish ki'ls alreacy caused by Con Edison in the i
operation of the much smallcr. adjacent plant Indian Point' Unit 1.
In 1963, there wet an enormous kill of fish shortly after this plant-began operating and the slaughter extended over a six month period.

There were smaller kills of fish from 1964 to 1969.
Starting in the fn31 of 1969 and running into January, 1970, there was l'
another enormous kill of fish at Indian Point which cama to-

Dominick J. Pirone, Consulting Biologist to ERFA and not an ottorney, wrote the Commission asking to I' esent testimony at the hearing on Indian Point Station' Unit No. E on November 25, 1970

If Mr. Pirone's ' letter had been accepted ac a petition, the filing y>uld have been timely.
