STATEMENT OF POSITION General Electric Company is the contractor for Jersey Central Power and Light Company for the design and construction of the Oyster Creek nuclear power plant. General Electric is also engaged in the manufacture and sale generally of botling water nuclear power plants l

As applicant has nottd, the conditions upon the provisional construction permit flowing from this error would add a burdensome complexity to that process in the instant case, m

The Board's Initial Decision and Order could have far-reaching and disturbing implications for the future administration of the Com-mission's regulatory prog ram. General Electric is entirely confident that, if necessary. the conditions upon the pronsional construction permit imposed by the Board in this case can and will be met. But the requirernent for the submittal of this information and data to the Board constituted to 3 view ine app.ication !or a construction permit isunnecessary. Exteting procedures, inc1; ding ACRS and Staff Review, aad the neces sity to qualify for an operating license, fully prote ct the inte re sts of the public, the Commis sion, and the industry in the safety of nuclea r plants.

Further review of cesign details by the construction permit Board would be a distortion ut the regulatory and licensing program contemplated by the Act and the Commission's regulations which, a s a precedent, could have serious adverse effects on the Commission's regulatory prot ram.

(1) Accept this Statement of Position in this proceedi ng.

Grant the Regulatory Staff's Petition for Review (3) Permit Ge neral Electric, in the event the Petition for Review is so granted, to file a brief within the period spec tfied for filing a reply brief, and to partici pate othe r wise a s ma y t,e app r opriate, upon the Com-mis sion's re view of the Bca rd's initial Dec t hion and Order.
