l Servlee regarding thermal polluttes of waterways by several amelear power i
plants. Of the comments received on Millstone (3/23/66), Quad-Cities j
(12/29/66), Palisades!(1/12/67), Turkey Point '(1/23/67), Browns Ferry.
I-(2/3/67) and Monticello (2/23/67), the most sigaaficant statements were l
those which were contained in the Millstone correspondence. The F6WL statements la the Millstone correspondence vere apparently made te clarify a comment to an appended report by Rice and babtist which statedt l
l "Although... (thermal pollutton) comaiderations are not withis i
the jurisdiction of the AEC and not involved la the pending AEC licensias proceedings, they may be of interest to appropriate

state and local agencies and to the applicant."
The cover memorandum from C. F. Fautska,. Commissioner, F6WL Service to H. L. Price, Director of Regulation contsiaed the following amplifications.
h "We wish to make clear that Dr. Rice's statements..., concerning

the jurisdiction and responalbility of the Atomic Energy Commission j
in regard to thermal pollution froe atomic plant, does j
not represent the policy of the Fish and Wildlife Service.
l Although we have submitted similar reports to 'the Commission i

l-i At your request, I have reviewed the statements from the Fish k Wildlife l
Service regarding thermal polluttom of waterways by several meelear power l
plants. Of the comments received on Millstone (3/23/66), Quad-Cities (12/29/66), Falisades (1/12/67), Turkey Point (1/23/67), Brevas Ferry (2/3/67) and Monticello (2/23/67), the most significant statessats were j
those which were contataed la the Millstone correspondence. The FkWL statements in the Millstone correspondence were apparently mode to clarify a consent in an appended report by Rice and Babtist which stated:
"Although... (thermal pollukten) conalderations are mot withis j
the jurisdiction of the AEC and not involved in the pending AEC licensing proceedtags, they may be of interest to appropriste l
state and local agencies and to the applicant."

"We wish to make clear that Dr. Rice's statements..., concerning l

not represent the policy of the Fish and Wildlif a Service.
Although we have submitted similar reports to the Commission i
before without comment, we believe that the AEC does have

j If the Commission still malatains that it does not have authority j
we believe it should refer the question to the Department of Justice,.and if the opinion of that Department supports the l
AEC view, then legislation. to provida this necessary authority should be sought by the Commission.
"Over the past year, Federal concern for all aspects of quality in our environment has greatly intemelfled. New laws l
have been enacted, others have been strengthened, and related Federal programm have been established and enlarged. As you know a f acet of this intensified concern vaa evidenced by the President on February 28, that the new Federal Water Pollution Control Administration be placed in this Department."
