Implementation cf Ford hnendment Pilot Program on Midland Plant, Units 1 and P.

This is to confirm our previous discussions concerning the independent design and construction verification (IDCV) program to be conducted by the TERA Cor-poration at Midland. Our discussions centered on.the use of this IDCV as one of the pilot programs under the provisions of Section 13 of Public Law 97-415 (NRC Authorization Act for FY 83).

As you know, this Congressional action requires an NRC study of existing and alternative programs for improving quality assurance and quality control in the construction of commercial nuclear power plants.

Acceptance of TERA Corporation for Independent Design and Construction Verification Program My letter of May 3,1983, indicated NRC acceptance of the TERA Corporation for the independent design and construction verification (IDCV) program with respect to the Midland Unit 2 Auxiliary Feedwater System (AFWS).

The letter also noted that the staff was awaiting a TERA submittal expanding the program scope to include two addi-tional systems. The expanded program plans wre submitted May 18, 1983, and incor-porated comments from the public meeting of April 13, 1983.

The staff has completed its review of the May 18, 1983, IDCV program doctnents, including TERA's independence and qualification statements.

Our previous findings accepting the independence and qualifications of the TERA organization and its team members continue to apply for the revised and expanded program. Our review of the May 18, 1983 Engineering Program Plan and Project Quality Assurance Plan also finds that the program sccpe is acceptable.

NRC comments generated during this review will be provided for your consideration during a futrre meeting.

During our review, the NRC has discussed with TERA and Consumers Power Company our selection of the Midland IDCV program with respect to initiatives required by Section 13 of Public Law 97-415 NRC Authorization Act for Fiscal Year 1983 (Ford Amend:r. ant). These initiatives cre intended to improve and verify the quality of nuclear power plants under construction. Tne hP.C is avaiting minor modifications to the IDCV progran. documents which will enhance its use for this purpose.

NRC review of these minor program modifications will be initiated upon receipt.
