HRC STAFF EVALUATION OF NIPSCO'S .

FIRST OVARTERLY REPORT

} ON THE PROGRESS OF THE BAILLY SITE RESTORATION

. Introduction Tne NRC staff received on June 4,1982, Northern Indiana Public Service Company's (NIPSCO) first quarterly report, dated June 1st, on its progress in restoring the site of the Bailly f acility. This report was filed in

. accordance with the Board Order of May 6,1982, which terminated the proceeding on NIPSCO's application to extend the CP for the Bailly facility. The staff 4 has reviewed this report and hereby provides its evaluation. Sections 1 through 4

. contains a brief summary of the NIPSCO report and Section 5 contains the staff's I present plans for an on-site inspection and its evaluation of NIPSCO's first j quarterly report.

l 1. Description of All Work Done A. Work Accomplished NIPSCO indicates in its first quarterly report that it has physically removed the sump pumps from the excavation and has also removed the recording equipment from the 49 observation wells outside the excavation. The staff has not verified the accomplishment of these specified activities since the amount of wod completed does not i justify an inspection. (Refer to Section 5.A of this evaluation.)

B. Work Authorized But Not Accomplished i

NIPSCO indicates that it has issued work orders to cap the groundwater

! observation wells and to dismantle the meteorological tower. As j of June 1,1982, this wod had not been started.

C. Work Planned But Not Authorized l NIPSCO indicates that it plans to backfill the excavation using either:

(1) one-third of the required fill material using the native sands on the site which were taken from the excavation and the balance from material dredged from Lake Michigan; or (2) one-third of the fill material from the on-site native sands and the balance from of f-site sources. NIPSCO indicates that it has received a permit from the Indiana Department of Natural Resources authorizing NIPSCO to implement the first option described above. It further indicates that it

. has applied for, but not received as of June 1st, pemits from the U. S. Amy Corps of Engineers and the Indiana Stream Pollution Control Board to dredge in Lake Michigan.

2. Description of All Remaining Site Work h

NIPSCO describes in its first quarterly report, six wo t items not yet he accomplished: backfilling of the excavation (Item 1.C); removal of the meteorological tower (Item 1.B); capping of the groundwater monitoring

T wells (Item 1.B); removal of the interior sheet piling; trimming of the 1 H-piles at an elevation of +8 f t.; and removal of the well points in the excavation.

' 3. Estimate of the Completion of Site P,estoration NIPSCO estimates that it has completed about five percent of the total wort effort required to restore the Bailly site in accordance with the 1 approved site restoration plan.

l 4. Estimated Completion Date I

j NIPSCO states in its first quarterly report that it will complete the i Bailly site restoration by September 1,1983.

5. Staff Evaluation A. On-Site Staff Inspection Due to the limited amount of site restoration wort accomplished to date, the staff has not made an on-site inspection. On the basis of the authorized and planned work outlined in NIPSCO's first quarterly

- report, we are currently planning to conduct an on-site inspection before our next quarterly evaluation in September 1982.

B. Evaluation of NIPSCO's Report NIPSCO has completed or authorized most of that work which does not depend on obtaining permits from regulatory bodies. Additionally, 4 f t has applied to the appropriate authorities for permits to perform I the remaining major work effort (i.e., backfill the excavation) and has requested bids on an alternate scheme for filling the excavation lj in the event that permission to dredge in Lake Michigan is unduly del ayed. Accordingly, we find that NIPSCO is being responsive

! to Board Order of May 8,1982. Additionally, we find that NIPSCO's

! estimate of the amount of work accomplished to be conservative j inasmuch as it has taken credit only for completing one-third of the required planning and has not taken credit for the physical work

! accomplished. Finally, we find NIPSCO's estimate of the date by I which it will cmplete restoration of the site to be reasonable, based .

j upon its two-pronged approach for accomplishing the major wort item 1 in the restoration plan (i.e., backfilling).

{ In summary, the NRC staff finds that NIPSCO has made reasonable progress in i restoring the Bailly site to date and has taken appropriate steps to ensure that it will comr1v with the Board Order within the schedule mandated by that Order.
