Dear Mr. Denton:

This is further response to my letter of D rrn M r 2, 1980, to Honorable John F. Ahearne, Chairnan, Nuclear Regulatory 0xrission, regarding construh dewatering and the construction permit extension for NIPSCD's Bailly Nuclear-1 and your response to that correspondence of December 30, 1980.

In answer to my request for information regarding hearings on renewal of NIPSCO's construction perrit for Bailly Ibclear-1, you noted that the subject hearing had not been scheduled bat that we would be Impt informed.

It is our present understanding that, while a specific date for the hearing has still not been scheduled, the NRC has established the date of August 28 as the last date for accepting depositions and interrogatories and that the hearing right be scheduled as soon as early Oc*wber of this year. We would appreciate you providing us with the latest inforration on the hearing, specifically:

-03 pies of any official orders issued relating to the construction perrit extension (Ibcket Ib. 50-367 CPA) since the issuance of the Atmic Safety and licensing Board's order of Aucust 7, 3 980.

-An up to date listing of the petitioners to whom the NRC has granted standing to intervene in the construction pemit extension proceeding and a list of the ratters and issues determined by IGC to date to be within the scope of the proceeding.

-Cbpies of any correrpondence or official orders requesting or allowing the s'dr-ission of 6epositions and interrogatories in this prn Wing and setting sig deadline for their suhrission.

-Cbpies of all interrogatories or depositions suhnitted to <hte in regard to this prrr- W ing and copies of those sub-itted hereafter.

.- n In your letter of Dec mber 30, 1980, you noted that you had concluded that NIPSCD's revised dewatering plan constituted, "...a reasonable approach to the problem of construct 1an dewatering ..." and, in your letter of November 21, 1979, to NIPSOD, you notM "... that the existing ronitoring and ritigation program can detect and interdict any adverse canditions before they affect offsite features (except for procedures for preventing and ritigating the effect of boils in the excavation) ."

We have recently requested and just received a copy of the E C Staff Evaluation of the Bailly Construction Pemit D: tension Regaest (July 17, 1981). That evaluation concludes that "On the basis of ... our evaluation and ritigation prcgram for construct 1an dewatering ... there will be no significant enviromental inpact ... other than that already predicted and described ...." The evaluation further notes that the NRC will require rodification to the permittee's ronitoring and ritigatlan program to be suhritted for NRC review and appal prior to ccrpleting the construct 1an perrit extension hearing.

As noted in former Se retary of Interior Andrus' lecter to Chai-n Ahearne of Octninr 3,1980, we are uvavemed that the revised construction dewatering will result in water level declines at Ctules Bog National Natural Iatark and that those water declines may not be able to be fully mitigated. 7nerefore, we request that you supply us with all correspondence between NRC and NIPSCO since December 30, 1980, regarding NIPSCO's proposed ronitoring and ritigation program for dewatering. ,lHe also ask that we be supplied with a copy of NIPSCO's ronitoring and -

ritigation progmm rodifications for review by the Nat. tonal Park Service and the U.S. Geological Survey prior to ccupletian of the construction pemit extension hearings. We ask that our review be canducted concurrent with the review by KRC and that any ccnnents this Departnent may have based on that review be considered by you in your review prior to construction per:rit extension hearings.

Because of our continuing interest in this matter, we ask that you include the National Park Service on your Service (railing) List for all matters related to Ibcket No. 50-367 CPA. Please include on this list copies to the follcwing individuals:
