Dear Administrative Judges:

On June 4, 1982 Business and Professional People for the Public Interest (BPPI) filed before the Licensing Board an " Application for Award of Fees and Expenses Under the Equal Access to Justice Act." By letter of June 14, 1982, Northern Indiana Public Service Company requested the advice of the Comission's Secretary "regarding the procedure and schedule in the event the

' Application' will be considered." The Staff agrees that it would be appro-priate to await the Secretary's " advice" before proceeding further with consideration of BPPI's Application, since under the Comission's regulations (10 C.F.R. % 2.717) the Licensing Board's jurisdiction over these proceedings has terminated. Accordingly, this letter is to advise you that the Staff will not file any response to the Application until the Secretary has rendered his advice as to the procedure to be followed and a schedule has thereafter been established.
