The NRC granted this extension by letter dated May 4, 1982. The purpose of this letter is to clarify the basis for our extension request and ask that the recent exemption granted for emergency lighting modifications be revised Y

to reflect our current status in meeting this commitment.

With reference to the schedule discussed in our November 16, 1981 letter, it was originaly believed that a plant shutdown for each unit would be necessary to make the required modifications.

As a result of extensive surveys conducted in pursuit of purchase and installation of 8-hour battery powered lighting units, it was determined that plant shutdown for modifica-tion would not be necessary. Therefore a request for relief from the schedular requirement of 10 CFR Part 50, Section 50.48.(c)(2) instead of Section 50.48 (c)(3) should have been made.

Not withstanding this fact, our ef forts to purchase suitable lighting units have been thwarted by unavailability of the lighting unit's power supply. A contract dispute between the lighting unit vendor and the manufacturer of the unit's battery forced delay in purchase of the lighting units until a substitute battery could be ident i f ied. The vendor has now modified their unit to accept a substitute battery and should be able to deliver the required' number of units in six weeks. This will not allow installation of Unit 2's battery powered lights by the end of the next refueling outage (July 1982) as stated in our exemption request. Installation of both Unit I and Unit 2 battery powered emergency lights should be completed by the exemption deadline for the Unit 1 lights (i.e. the end of the next refueling outage for Unit 1 (December 1982)).

Accordingly we are asking that the exemption from Appendix R,Section III.J granted in enclosure 1 of your May 4,1982 letter be modified as follows:

(4) The implementation date in paragraph (c)(2) for the installation of modifications required by Appendix R,Section III.J, that do not require prior NRC approval or plant shutdown, beEextended from nine months after February 17, 1981, to nine i

months after April 1,1982.

We regret this oversight in our November 16th request and ask that this revised request be approved. For reasons stated in our letters of March 19 i

i and November 16, 1981, we believe the delay in modifications to our existing i

emergency lighting system will not jeapordize public health or safety.

Please contact us if you have any questions concerning this request to modify our existing exemptions or if we can furnish additional information related to this issue.
