1 PROCEEDINGS fy k-)

2 (10:00 a.m.]

3 JUDGE BLOCH:

This is Peter Bloch, Chairman of the 4

Licensing Board in the Tennessee Valley Authority Sequoyah 1

5 Nuc) oar Plant Application for an Amendment to its License 6

concerning Technical Specifications for Work schedules.

The 7

Docket Numbers in this case are 50-327 OLA and 50-328 OLA.

8 Hero with m.e in my office is Judce James H.

9 Carpenter.

We also have in my office, at the request of the 10 parties, a Court Reporter.

The call has been called at the 11

. request of the parties, communicated to my office on Friday 12 by Janice Moore.

The purpose of today's talk, is I

[')

13 understand it, is to discuss the possibility of settlement

's_/

14 in this case.

15 What'I would til.e to do is ask the parties to 16 identify themselves for the record, starting with

-17 Intervenors.

8-NR. SPRINGFIELD:

Is'that me?

19 JUDGE ELOCH:

Yes.

3HF MR. SPRINGFIELD:

My name is James T.

Springfield, 21-and I am the Business Manager.for I.B.E.W.

Local 721.

I am

-22 also a reactor operator at Sequoyah Nuclear Plant,.and I am 23 doing this in representation of the members of the operators i

S hern at the Sequoyah Nuclear Plart.

24 25 JUDGE BLOCH:

Thank you.

Technically you are

)

~'

l t

l-r

4 correct, you are a Petitioner at this point. I haven't ruled 1

K-)

2 that you are an intervenor, so would be a little hard to 3

know how to identify yourse.f at that.

4 Do you have any objection with what I stated to be 5

the purpose of the conference?

6 MR. SPRINGFIELD:

Certainly, I think that I was 7

under the impression that the purpose was to give an 8

extension to the time of response that TVA had to make to 9

this issue to see if we could work it out at this March lith 10 meeting that we are going to have.

Really, after that, we 11 would more know whether we would be able to work it out or 12 not.

[ )D 13 MR. BORDENICK:

Judge Bloch, this is Bernie R

14 Bordenick.

I haven't identified myself yet, but can I jump 15 in here?

I was hoping to be the spokesperson for the --

16 JUDGE BLOCH:

If you would, please identify 17 yourself and the other staff attorney's, and then you can 18 make a brief statement on the purpose of the call alt,o.

19 MR. BCPCENICK:

All right.

As I indicated, I am 20 Bernard Borden17k.

I am with the Office of Ganeral Counsel, 21 U.S.

Nuclear Regulatory Commission.

I am representing the 22 staff in this proceeding.

-1 JUDGE BLOCH:

No, we have it.

2

-MR. BORDENICK:

Okay, fine.

Perhaps, Judge Bloch, 3

you might want to take the appearance of TVA and then come 4

back to me.

I will try to be th^ spokesperson.

5 JUDGE BLOCH:

Representing Applicant-today is --

6 MR. NICHOLS:

This is Douglas R.-Hicnols.

I am 7

Assistant General Counsel, OffA0e of the General Counsel in 8

TVA, representing TVA on this laatter.

9.

JUDGE BLOCH:

Thank you very much.

Mr. Bordenick.

10 MR. BORDENICK:

Okay.

As Mr.-Springfiel,d started

- to allude to, the parties have conferred by-telephone --

12

.when ITsay parties I mean the Union, TVA and the_Sthif.

We

'13 have agreed to hold a. meeting among ourselves nev. Monday, 14 that is, March lith, in Chattanooga, to discuss the issues 11 5

-in this' case and see what the' possibilities are for

-16 resolving the_' matter.

17-

Also, in-connection withLthat' meeting, we request-

'18 L the Board to e-tend the time for the responses to the 3F

hearing regrast until March-26th..I think1I have summarized:

3 20 what.the parties discussed last Friday.

If I, haven't, I am

'21 sure either Mr. Nichols or Mr. Springfield will correct me.

22 JUDGE BLOCH:

The only thing that puzzles me about 23-that is, why> you said ina needed a Court Reporter for this.

I-24 call if the purpose is just to agree 'on that procedure and-

' 2 5-V.:e extensionlaf time.

MS.. MOORE:

This is Janice Moore.

2; MR.'BORDENICK:

She was_the one that --- MS.-MOORE:

That was my fault, I am' afraid.

When 4-I spoke with your Secretary we_weren't sure if there was 5

_anything else that'you wished to talk about at the 6

conference call.

When she asked me_I said yes, we wouldn't

-7 mind having a Court Reporter.

8 JUDGE BLOCH:

If the parties prefer to talk about 9

settlement amongLthemselves, I have no desire to' disturb

~ 10 -

their-preferences.-I wculd just like to ask Fr. Nichols if.

11 he ' has any different under*Aanding from what Mr. Bordanick

just said?._

i I l [~') '

13-MR.,NICHOLS:- No, my understanding,. Judge Bloch, V

like~the-'same extension.

! JUDGE-BLOCH: -If I understand-correctly,_the 17c extension will.be;until March 15th?

J18 MR. BORDEN1CK:- No, March 26th.
