NUCLEAR REGULATORY COMMISSION (NRC) - REQUEST FOR COMMENT ON PROPOSED RULEMAKING 10 CFR PART 50, SHUTDOWN AND LOW POWER OPERATIONS FOR NUCLEAR POWER REACTORS The Tennessee Valley Authority (TVA) is pleased to provide comments on the subject proposed rulemaking published in the October 19, 1994, Federal Reaister (59 FR 52707-52714).
TVA has reviewed and worked closely with the Nuclear Energy Institute (NEI), the Boiling Water Reactor Owners Group (BWROG), and the Westinghouse Owners Group (WOG) to develop comments and is in total agreement with NEI's, BWROG's, and WOG's submittals on the proposed rulemaking. These comments reflect the seriousness of this issue and illustrate areas in which the proposed rule is technically flawed.
Proceeding with the proposed rule should be reconsidered.
TVA is especially concerned that NRC has chosen to move forward with this proposed rule after industry has taken aggressive actions to resolve this issue. We believe NRC's propagation of proposed rulemaking on this issue is contrary to NRC's desire to have the nuclear power industry resolve identified issues.
