Request for an Extension of time to submit the final calculation file to RAIs 2a and 2b and to respond to questions to be raised regarding the remaining 16 Technical Specifications The University of Maryland hereby respectfully requests an extension of time to January 31, 2011, (1) to submit the final calculation file that supplements the University's Response for Additional technical Information (RAI) 2a and 2b and (2) to respond to questions the NRC will raise regarding some of the University's responses to the remaining sixteen Technical Specification RAIs submitted on November 29, 2010. An on site visit is scheduled the week on December 20th to discuss those remaining Technical Specifications.

The University would have preferred to have been able to submit the complete response to RAIs 2a and 2b by the November 15, 2010 deadline. As you know, the University must rely on General Atomics (GA) to provide answers to those 2 RAIs. GA pledged to provide complete responses by the November 15 deadline, but did not. It then pledged to send the final calc file to the University by December 13, after the independent review was completed. Instead of sending the final calc file, GA sent a draft calc file to the University on December 10 with the explanation that its "usual nuclear independent reviewer is on vacation till next year, so [it had asked another person to do the review for the MUTR work." GA did not provide a date the review would be completed: it said it would forward the final calc final as soon as the review was completed. Without a more definitive statement from GA, we cannot promise delivery before the end of the year. We do believe that an extension to January 31, 2011 is feasible.

The University also requests an extension of time to provide additional information and clarifications on the remaining 16 Technical Specifications. We will not know what the issues are until you come for on site visit next week. December 23 is a University furlough day and then the University closes until January 3, 2011. Because of the

Document Control Desk US Nuclear Regulatory Commission December 14, 2010 Page 2 of 2 closures, it will be impracticable and difficult to provide complete responses to the issues you describe to us next week until the end of January.

We will continue to encourage a quicker submission of the final calc file and if either it or our own clarifications on the Technical Specifications are completed before January 31, 2011, we will promptly forward them to you.
