NINE MILE POINT NUCLEAR STATION, UNIT NO.2 - REVIEW OF EXTENDED POWER UPRATE LICENSE AMENDMENT APPLICATION AND REVISED REVIEW SCHEDULE (TAC NO. ME1476)

Dear Mr. Belcher:

By letter dated May 27, 2009 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML091610103), as supplemented by letters dated August 28,2009, (ML092460550), December 23, 2009 (ML100190072), April 16, 2010 (ML101120658), May 7, 2010 (ML101380307), and June 3, 2010, Nine Mile Point Nuclear Station, LLC (NMPNS or the licensee) submitted a license amendment request (LAR) for Nine Mile Point, Unit NO.2 (NMP2).

The proposed amendment requests an increase in the maximum steady-state power level at NMP2 from 3467 megawatts thermal (MWt) to 3988 MWt. This represents a 15-percent increase over the current licensed thermal power.

By letter dated March 10, 2010 (ML100630108), the Nuclear Regulatory Commission (NRC) staff submitted a request for additional information (RAI) concerning the application. The RAI was discussed with your staff on February 26, 2010, and it was agreed that your response would be provided within 60 days from the date of that letter. Additionally, on March 18, 2010, a closed meeting was held between the NRC staff and representatives of NMPNS to discuss the licensee's proposed analysis and validation methods necessary to address the technical areas described in the NRC staff's RAI letter. By letter dated May 7, 2010 (ML101380307), NMPNS provided a partial response to the RAI, which included a commitment to submit responses to the remaining RAI questions (Nos. 6, 7, 8, 9, 11, 12, 20, 21, and 24) by June 30, 2010.

To date, the NRC staff has completed a substantial portion of the review of the application, and acknowledges that NMPNS has been responsive to all other NRC staff RAI requests. The original projection for the completion of the review of the LAR was August 2010. However, due to the delays associated with the March 10, 2010, RAI letter, the staff has revised its schedule, and projects completion of the review by December 2010. It is our understanding that the revised schedule continues to support your requested approval date. As indicated in your May 27, 2009, application, you requested approval of the application in 18 months with a planned implementation upon startup from the spring 2012 refueling outage. We ask that you keep the staff informed if your schedule should change or if any additional delays are foreseen.
