MID-CYCLE PERFORMANCE REVIEW AND INSPECTION PLAN -

DRESDEN NUCLEAR POWER SATION

Dear Mr. Pardee:

On August 20, 2009, the NRC staff completed its performance review of the Dresden Nuclear Power Station. Our technical staff reviewed performance indicators (PIs) for the most recent quarter and inspection results for the period from July 1, 2008, through June 30, 2009. The purpose of this letter is to inform you of our assessment of your safety performance during this period and our plans for future inspections at your facility.

This performance review and enclosed inspection plan do not include security information.

A separate letter designated and marked as "Official Use Only--Security Information" will include the security cornerstone review and resultant inspection plan.

Plant performance for the most recent quarter at the Dresden Nuclear Power Station was within the Licensee Response column of the NRC=s Action Matrix, based on all inspection findings being classified as having very low safety significance (Green) and all PIs indicating performance at a level requiring no additional NRC oversight (Green). Therefore, we plan to conduct reactor oversight process (ROP) baseline inspections at your facility.

There were five inspection findings during the assessment period with documented cross-cutting aspects in the area of Problem Identification and Resolution (PI&R). There is a cross-cutting theme with four of these findings, which affected multiple cornerstones (i.e., Initiating Events, Mitigating Systems, and Barrier Integrity). This cross-cutting theme involves the stations ability to take appropriate corrective actions to address safety issues and adverse trends in a timely manner, commensurate with their safety significance and complexity, P.1(d). In evaluating your scope of efforts and progress in addressing the cross-cutting theme, we determined that you have appropriately identified the cross-cutting theme and have scheduled or taken a range of corrective actions to address the issue. Based on the recent time-frame associated with some of these performance issues, corrective actions have not reasonably been in place long enough to determine their effectiveness. Therefore, the staff has concluded that a substantive cross-cutting issue in PI&R is not warranted at this time. We will continue to monitor the effectiveness of these corrective actions as part of our ongoing assessments.

C. Pardee On August 19, 2009, we issued a preliminary White inspection finding related to an inadvertent rod withdrawal event that occurred at Dresden on November 3, 2008 (ML092320164). This finding was not included within this assessment since the final significance had not yet been determined. Following the final significance determination, the finding will be included in the assessment process and additional inspection(s) will be conducted, as appropriate.

The enclosed inspection plan details the inspections, less those related to physical protection scheduled through December 31, 2010. The inspections scheduled include: licensed operator initial and requalification, emergency preparedness, biennial problem identification and resolution, component design basis, ground water protection initiative, and outage related inspections. The inspection plan is provided to allow for the resolution of any scheduling conflicts and personnel availability issues well in advance of inspector arrival onsite. Routine resident inspections are not listed due to their ongoing and continuous nature. The inspections in the last 9 months of the inspection plan are tentative and may be revised at the End-of-Cycle review.

In accordance with 10 CFR 2.390 of the NRC=s ARules of Practice,@ a copy of this letter and its enclosure will be made available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS). ADAMS is accessible from the NRC Website at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room).

As you may know, the NRC is currently evaluating the scope and frequency of all the baseline inspection procedures. If the results of the evaluation, or any other circumstances, cause us to change the inspection plan, we will contact you to discuss the change as soon as possible.
