DRESDEN NUCLEAR POWER STATION, UNIT 1 - REVISED REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE RE:

ALTERNATIVE SCHEDULE TO COMPLETE DECOMMISSIONING BEYOND 60-YEARS OF PERMANENT CESSATION OF OPERATIONS (EPID: L-2024-LLE-0012)

Dear Mark Humphrey:

By letter dated March 14, 2024 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML24074A436), Constellation Energy Generation, LLC (CEG) submitted a request to the U.S. Nuclear Regulatory Commission (NRC) to allow the completion of decommissioning for Dresden Nuclear Power Station, Unit 1 (Dresden Unit 1) beyond 60 years of permanent cessation of operations. The submittal requested that the information in of the letter be withheld from public disclosure in accordance with the requirements of Section 2.390(d)(1) of Title 10 of the Code of Federal Regulations, because it contains Sensitive Unclassified Non-Safeguards Information (SUNSI) documentation.

NRC staff reviewed your application and the supporting information and denied your request, by letter dated July 24, 2024 (ML24193A088), because CEG did not provide sufficient justification for us to determine that Attachment 1 of the March 14, 2024, submittal should be withheld from public disclosure. In your response dated July 31, 2024 (ML24213A313), you provided justification for requesting that Figure 1-1, in Attachment 1 of the March 14, 2024, submittal be withheld from public disclosure because it contains geological and geophysical information and data.

The NRC staff determined the subject figure should be withheld, and a nonproprietary copy of of the March 14, 2024, submittal has been placed in the NRCs Public Document Room and added to the NRC Library (ML24215A278).

In accordance with 10 CFR 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs ADAMS. ADAMS is accessible from the NRC Website at http://www.nrc.gov/reading-rm/adams.html.

Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.

Humphrey If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC. You also should understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act request includes your information. In all review situations, if the NRC makes a determination adverse to the above, you will be notified in advance of any public disclosure.
