WAITS BAR NUCLEAR PLANT, UNIT 2 - REQUEST FOR ADDITIONAL INFORMATION REGARDING FINANCIAL INFORMATION RELATED TO OPERATING LICENSE APPLICATION UPDATE (TAC NO. ME0853)

Dear Mr. Bhatnagar:

In a letter dated March 4, 2009, to the U.S. Nuclear Regulatory Commission (NRC), the Tennessee Valley Authority provided an operating license application update for the Watts Bar Nuclear Plant, Unit 2.

The NRC staff has reviewed your submittal regarding financial qualification and finds that it does not provide sufficient information for us to make a conclusion that financial qualification has been demonstrated. The specific information needed is detailed in the enclosure.

REQUEST FOR ADDITIONAL INFORMATION BY THE OFFICE OF NUCLEAR REACTOR REGULATION OPERATING LICENSE APPLICATION UPDATE WATTS BAR NUCLEAR PLANT UNIT 2 DOCKET NO. 50-391

1) Foreign Ownership, Domination, or Control According to Title 10, Code of Federal Regulations (10 CFR) Section 50.33(d)(3),

If applicant is a corporation or an unincorporated association, state:

(i) The state where it is incorporated or organized and the principal location where it does business; (ii) The names, addresses and citizenship of its directors and of its principal officers; (iii) Where it is owned, controlled, or dominated by an alien, a foreign corporation, or foreign government, and if so, give details.

Tennessee Valley Authority (TVA) did not provide an update to the above information about its organization. Therefore, the Nuclear Regulatory Commission requests that TVA update the information described above.

2) WBN Unit 2 Decommissioning Funding Mechanism Page E1-2 of TVA's Watts Bar Nuclear Plant, Unit 2, updated application states that TVA currently has a Master Decommissioning Trust Agreement and "consistent with this current practice and pursuant to 10 CFR 50.75(e)(1), a Fund will be established within the Master Decommissioning Trust Agreement for Watts Bar Unit 2 ...."

According to 10 CFR 50.75(e)(1),

Financial assurance is to be provided by the following methods.

(i) Prepayment.

(ii) External sinking fund.

(iii) A surety method, insurance, or other guarantee method [...].

Pursuant to 10 CFR 50. 75(e)( 1), please provide the exact method for establishing financial assurance.
