PUBLIC NOTICE NRC STAFF ANNOUNCES OPPORTUNITY FOR PUBLIC PARTICIPATION IN PROPOSED NRC ACTION ON OPERATING LICENSE APPLICATION FOR WATTS BAR NUCLEAR PLANT, UNIT 2 The U.S. Nuclear Regulatory Commission (NRC, the Commission) is giving notice that it has received from the Tennessee Valley Authority (TVA) an update to the application for a facility operating license for a second light-water nuclear reactor at the Watts Bar Nuclear Plant site in Rhea County, Tennessee. The proposed operating license would authorize TVA to possess, use, and operate Watts Bar Unit 2.

On March 4, 2009, TVA updated the original application sent to the NRC on June 30, 1976, for both Units 1 and 2, which the NRC found acceptable for docketing on September 15, 1976. A "Notice of Receipt of Application for Facility Operating Licenses; Notice of Consideration of Issuance of Facility Operating Licenses; and Notice of Opportunity for Hearing" for Watts Bar Units 1 and 2 was published in the Federal Register on December 27, 1976. On February 7, 1996, the NRC issued a full-power operating license authorizing TVA to operate Watts Bar Unit 1. However, TVA has not completed construction of Watts Bar Unit 2. Construction was authorized by Construction Permit No. CPPR-92 on January 23, 1973. TVA has now reactivated construction of Watts Bar Unit 2 and has stated that it expects to complete construction prior to April 1, 2012.

A "Notice of Receipt of Update to Application for Facility Operating License and Notice of Opportunity for Hearing and Order Imposing Procedures for Access to Sensitive Unclassified Non-Safeguards Information and Safeguards Information for Contention Preparation" was published in the Federal Register on May 1, 2009. The notice provides that within 60 days after publication of notice in the Federal Register, any member of the public whose interest may be affected by the proceeding may file a request for a public hearing in the form of a petition for leave to intervene with respect to whether an operating license should be issued. Individuals should refer to the details and procedures for filing in the published notice.

A copy of the Federal Register notice is on file for public inspection at the Commission's Public Document Room, located at One White Flint North, Public File Area 0-'1 F21, 11555 Rockville Pike (first floor), Rockville, Maryland.
