SUMMARY

OF MANAGEMENT ACTIONS Medical Review Officer (MRO) Six Month Report From July 1, 2003, through December 31, 2003, our records indicate the following results:

In the licensee personnel pool, Random program category, three (3) confirmed positives for a single substance were documented. In the short-term contractor personnel pool, Pre-Access program category, five (5) confirmed positives for single substances were documented. In the For-Cause program category (Observed Behavior), one (1) confirmed positive for a single substance was documented.

Random Program In the Random program category, licensee personnel pool, three (3) confirmed positives for a single substance were experienced. Each individual participated in separate face-to-face interviews with the Medical Review Officer and was provided the opportunity for split-specimen testing. One (1) individual, a temporary licensee employee, experienced employment termination. Another individual, a security employee, was terminated in accordance with the security employers policy. The third individual was placed on a 14-day suspension, unescorted access was denied and the individual participated in and successfully completed the Employee Assistance Program recommendation.

Subsequently, this individual returned to work and is presently participating in the licensee follow-up program.

Pre-Access Program In the Pre-Access program category, short-term contractor personnel pool, five (5) confirmed positives for a single substance were experienced. Each individual participated in separate face-to-face interviews with the Medical Review Officer and was provided the opportunity for split-specimen testing. One (1) individual was confirmed positive, by the Medical Review Officer, for alcohol by the extrapolation process. The Medical Review Officer adjudicated all five (5) individuals as confirmed positive and unescorted access was denied. The Medical Review Officer also recommended that each individual should participate in their respective Employee Assistance Programs.

For-Cause Program In the For-Cause program category, short-term contractor pool, one (1) confirmed positive was experienced. The individual requested a Blood Alcohol sample be drawn which resulted in confirmation of the confirmatory breath sample result. The individual

Beaver Valley Power Station, Unit No. 1 & 2 Fitness-For-Duty Six Month Report Page 2 participated in a face-to-face interview with the Medical Review Officer and was adjudicated as a confirmed positive, and denied unescorted access. The Medical Review Officer recommended that the individual should participate in their employer's Employee Assistance Program.

List of Events Reported On August 15, 2003, an individual licensed under 10 CFR Part 55, was randomly tested for fitness for duty and found to have a blood alcohol content (BAC) level of 0.010 percent. The Medical Review Officer determined, by extrapolation, that the individuals BAC did not exceed the limit of 0.04 percent for their time reporting to work prior to the random test. Therefore, the Medical Review Officer adjudicated the test as a negative result. However, based on a face-to-face interview, it was the opinion of the Medical Review Officer that the individual be relieved of work duty and referred to the Employee Assistance Program for evaluation. The individuals license status was not in active status and, therefore, the individual was not performing licensed duties at the time.

The NRC Resident Inspector was notified and the event reported pursuant to 10 CFR 26.73(a)(2).

On August 20, 2003, the individual complied with the Medical Review Officer recommendation and participated in an evaluation by the Employee Assistance Program.

Based on a comprehensive drug and alcohol assessment, the substance abuse professional did not find this individuals alcohol consumption to be problematic, abusive or in the addiction phase. The individual was returned to work on August 26, 2003, and participated in a Medical Review Officer face-to-face interview. There were no further recommendations of treatment, assessment or follow up. A return to work, pre-access test was completed with negative result.
