Beaver Valley Power Station, Unit Nos. 1 and 2 Docket No. 50-334, License No. DPR-66 Docket No. 50-412, License No. NPF-73 Withdrawal of Exemption Request (EPID L-2023-LLA-0036)

By letter dated February 14, 2023, [Agencywide Documents Access and Management System Accession No. ML23045A144], Energy Harbor Nuclear Corp. requested an exemption in accordance with 10 CFR 50.12 from a requirement of Appendix H to 10 CFR Part 50, Reactor Vessel Material Surveillance Program Requirements, for Beaver Valley Power Station, Unit No. 1 (BVPS-1). Specifically, the exemption of supplemental capsule A, from the Appendix H,Section IV.A requirement that each capsule withdrawal and associated test results must be the subject of a summary technical report that is to be submitted to the NRC Regulatory Commission (NRC) within eighteen months of the date of capsule withdrawal, unless an extension is granted by the Director.

Effective March 1, 2024, the facility operating license for BVPS was transferred from Energy Harbor Nuclear Generation LLC (owner) and Energy Harbor Nuclear Corp. (operator) to Energy Harbor Nuclear Generation LLC (owner) and Vistra Operations Company LLC (operator) (Accession No. ML24057A092). Upon completion of this license transfer, Vistra Operations Company LLC (VistraOps) assumed the responsibility for all licensing actions under NRC review at the time of the transfer and requested that the NRC continue its review of these actions (Accession No. ML24054A498).

On March 26, 2024, a clarification call was held with VistraOps personnel and the NRC Project Manager to discuss the exemption request. As a result of this discussion, VistraOps hereby withdraws the exemption request.

VistraOps intends to submit a new request for a revision to the BVPS-1 vessel material surveillance program withdrawal schedule.
