Dear Sir:

l This application for proposed amendment to the James A. FitzPatrick Technical Specifications

! (TS) requests that the snubber operability, surveillance, and records requirements in the TS be relocated to plant controlled documents. These proposed changes are based on the

, - guidance presented in NUREG-1433 (Reference 1) and NEDO-31466 (Reference 2), and on l the criteria presented in NRC regulation 10 CFR 50.36 (Reference 3), and are consistent with l NRC and industry efforts to simplify the TS. The plant controlled documents associated with j l

the relocated requirements will be referenced in the first FSAR update due more than six ,

months after NRC issuance of the amendment.

Approval of the proposed amendment is requested prior to the start of the next inservice l Inspection (ISI) program ten year interval which commences on June 28,1997. This will l avoid conflicts between the current surveillance requirements in the TS and the ASME Boiler l

& Pressure Vessel Codes. The Authority requests a ninety (90) day period after the amendment is issued to implement concurrently the plant controlled procedures and the requested Technical Specification revisions.

The signed original of the Application for Amendment to Operating License is enclosed for filing. Attachments I and 11 to this application contain the proposed changes to the TS and the associated safety evaluation, respectively. A mark-up of the affected TS pages is included in '

! Attachment Ill. Attachment IV summarizes the commitments made in this submittal.
