NOTICE OF VIOLATION (NRC INSPECTION REPORT NOS. 50-250/89-02 AND 50-251/89-02)
This refers to the Nuclear Regulatory Commission (NRC) inspection conducted by J.
L.
Kreh on January 17-20, 1989.
The inspection included a review of activities authorized for your Turkey Point facility.
At the conclusion of the inspection, the findings were discussed with those members of your staff identified in the enclosed inspection report.
Areas examined during the inspection are identified in the report.
Within these areas, the inspection consisted of selective examinations of procedures and representative records, interviews with personnel, and observation of activities in progress.
The inspection findings indicate that your response to an incident on January 7,
1989 appeared to violate NRC requirements.
The violation involved failure to declare an Alert and to appropriately implement the Radiological Emergency Plan following a Reactor Coolant System leak which clearly met the criteria for an emergency declaration.
Such a condition, no matter how briefly it existed, must be promptly declared at the appropriate emergency class and r'eported in a timely manner to local, State, and Federal authorities so that they are informed of unusual or significant events at the facility.
Although we considered classification of this violation at Severity Level III, it has been classified at Severity Level IV based on its low safety significance, in that the affected unit was at cold shutdown and effective mitigating actions were taken to quickly stop the leak.
However, we emphasize that any similar violation in the future may result in escalated enforcement action.
The violation is further described in the enclosed Notice of Violation; also delineated therein are references to pertinent requirements and elements to be addressed in your response.
In accordance with Section 2.790 of the NRC's
"Rules of Practice,"
Part 2, Title 10, Code of Federal Regulations, a copy of this letter and its enclosure will be placed in the NRC Public Document Room.
