Title

Failure to report a condition prohibited by Technical Specifications

Description

The NRC identified a non-cited violation (NVC) of 10 CFR 50.73(a)(2)(i)(B) for the licensees failure to submit a License Event Report (LER) for a condition prohibited by plant technical specifications within 60 days of the event. The licensee entered this issue into their corrective action program as Problem Event Report 796578. LER 50-259 2013-006-00 was submitted on December 4, 2013. The failure to make reports to the NRC as required by 10 CFR 50.73(a)(2)(i)(B) impacted the regulatory process and was a violation of NRC requirements. The violation was processed using traditional enforcement and determined to be a Severity Level IV violation consistent with NRCs Enforcement Policy section 6.9.d.9, Inaccurate and Incomplete Information or Failure to Make a Required Report. Because this violation involved the traditional enforcement process with no underlying technical violation that would be considered more than minor in accordance with IMC 0612, a cross-cutting aspect was not assigned to this violation.
