BROWNS FERRY NUCLEAR PLANT - NRC SPECIAL SECURITY INSPECTION REPORT 05000259/2013405, 05000260/2013405 AND 05000296/2013405
Dear Mr. Shea:
On June 4, 2013, the U.S. Nuclear Regulatory Commission (NRC) completed a special inspection at your Browns Ferry Nuclear Plant, Units 1, 2, and 3. The enclosed inspection report documents the inspection results that were discussed on June 21, 2013, with Mr.
K. Polson and other members of the Browns Ferry Nuclear Plant staff.
The inspection was commenced on May 29, 2013, in accordance with NRC Management Directive 8.3, NRC Incident Investigation Program, and Inspection Manual Chapter 0309, Reactive Inspection Decision Basis for Reactors, based on the initial risk and deterministic criteria evaluation made by the NRC on May 29, 2013.
The special inspection reviewed the circumstances surrounding a potential tampering event on a fuel oil pressure sensing line for an Emergency Diesel Generator (EDG), which occurred potentially between April 27, 2013 and May 26, 2013, and examined activities conducted under your license as they relate to safety, security, and compliance with the Commissions rules and regulations and with the conditions of your license.
Based on the results of this inspection, the NRC has determined that one Severity Level IV violation of NRC requirements occurred. This violation is being treated as a non-cited violation consistent with Section 2.3.2 of the NRC Enforcement Policy. The NCV is described in the subject inspection report. If you contest this non-cited violation, you should provide a response within 30 days of the date of this inspection report with the basis for your denial, to the Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555-0001; with copies to the Regional Administrator Region II, Director, Office of Enforcement, United States Nuclear Regulatory Commission, Washington, D.C. 20555-0001; and the Senior Resident Inspector at the Browns Ferry Nuclear Plant. In accordance with Title 10 of the Code of Federal Regulations (10 CFR) 2.390 of the NRC's
"Rules of Practice," a copy of this letter will be available electronically for public inspection in the NRC Public Document Room, or the Publicly Available Records (PARS) component of NRC's Agencywide Documents Access and Management System (ADAMS). ADAMS is accessible from the NRC Website at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room). However, the material enclosed herewith contains Security-Related Information in accordance with 10 CFR 2.390(d)(1), and its disclosure to unauthorized individuals could present a security vulnerability. Therefore, the material in the Enclosure will not be made available electronically for public inspection in the NRC Public Document Room, or from the PARS component of NRCs ADAMS. If you choose to provide a response and Security-Related Information is necessary to provide an acceptable response, please mark your entire response "Security-Related Information - Withhold from public disclosure under 10 CFR 2.390," in accordance with 10 CFR 2.390(d)(1), and follow the instructions for withholding in 10 CFR 2.390 (b)(1). In accordance with 10 CFR 2.390(b)(1)(ii), the NRC is waiving the affidavit requirements for your response.
