Thedetailsofthe~problemaresetforthinaletterdatedAugust24,1978,totheU.S.Department ofEnergy,acopyofwhichisenclosed.

IntheeventthatR.R.S.Security, Inc.and/orIndianaMichiganPowerCompanydonot,retainthecurrentsecurityforceofcompetent andexperi-encedemployees, theconsequences setforthinmylettertotheDepart-mentofEnergywillberealized.

Xtisinconceivable thatafederalregulatory agencyshoulddirectlyorindirectly foster,supportorcondoneanyactionwhichiscontraryto"federalpolicy"generally.

Iwouldliketoassumethatgovernment policiesintheareasoflaborrelations, fullemployment, equalrightsandothersarecoordinated amongthefederalagencies.

Itbegsthequestionforanyfederalagencytoassertthattheyhavenoauthority tocorrectapendingproblemand/ortoreferthatproblemtoanotheragency.whetherornotafederalagencyhasspecificstatutory authority orjurisdiction inagivenarea, itisnonetheless inapositiontoinstitute remedialactionbythesheerapplication of"federalpolicy".Thetimehascome,andtheDonaldC.CookNuclearPlantillustrates theproblem, forthefederalgovernment tobebothconcerned andinvolvedwhereprivatecompanies contravene variousfederalpolicieswhileoperatinunderfederalcontrolandapproval.

Unchecked biddingonfederally regulated projectshasnumerousadverseconsequences.

First, thereisunnecessary costtothetaxpayerintermsofnewsecurityclearances, recruitment andtrainingofemployees, unem-ploymentandwelfarecosts,andoverallfinancial losstoacommunity intaxandconsumerdollars.Second, thereisperiltothesecurityofafacilityinthatcontinuity ofoperations isbrokenandformeremployees whohaveanintimateknowledge ofthefacilitytendtoremaininthecommunity.

Third,thesituation isproductive oflaborunrestcontrarytothemandateoftheNationalLaborRelations Acttopromoteandpreservindustrial stability.

And,finally,thelossandhardshipsufferedbyemployees andtheirfamiliesisincalculable.

Dr.CliffordV.SmithNRC)Page-2-9-&-7&TheproblemIhavedescribed isnotlimitedtotheCookNuclearPlantatBridgman, Michigan.

Itismushrooming throughout theCountry.Securityguardswhohavegivenmanyyearsofdedicated andcompetent servicetoafederally ownedand/orprivately ownedbutfederally regulated facilityaresuddenlyadvisedthattheiremployment isterminated.

Theyneitherinfluence norcontrolthatdecisionandarepowerless toreverseit.Theyaresimplyvictimsofabiddingsystemwhichvariousfederalagencieshave"failedtoregulateinthebestinterestofasecurityperformance, employeejobsecurityandtaxpayerwelfare.Onlythecontractor andsub-contractor benefitbysystemwhichabrogates collective bargaining agreements andempl,oyee job'security, andperpetuates sub-standard wagesandbenefits.

Itisnowonderthatguardagencyoperations aremarkedbyhighemployeeturnoverandreducedsecurityperformance.

Yetwhenemployees throughcollective actionraisetheirwages, benefits, andjobsecuritytoadecentlevel, theprincipal contractor reletsthebidtoanunorganized guardagency.Unfortunately, theServiceContractActandotherlegislation isnotadequatetocorrectthesituation.

Thereisbothacompelling needforspecificlegislation and, mostparticularly, foranewattitudeandmeansofcommunication andcooperation amongfederalregulatory agencies.

ThoughitisnotMissJohnstonsfirstquestion, itseemsbesttobeginbyidentifying NRC.TheNuclearRegulatory COIImrission cameintobeingbyenactment oftheEnergyReorganization Actof1974andbeganofficialoperation onJanuary19,1975.Priortothattime,theAtomicEnergyCommission wasresponsible forbothdevelopmental andregulatory activities associated withnuclearenergy, including powerplants,undertheAtomicEnergyActof1954.TheAECwasdissolved bytheEnergyReorganization Actof1974whichplaceditsregulatory functions unde'rtheNRCanditsdevelopmental functions under, theEnergyResearchandDevelopment Administration.

TheNRCisalsogovernedbyprovisions oftheNationalEnvironmental PolicyActof1969.Assetforthinthesestatutes, theprimarymissionoftheNRCistoassurethatcivilian-nuclearactivities areconducted inamannerwhichwillprotectpublichealthandsafety,nationalsecurityandenvironmental quality.Thisisdonethroughasystemoflicensing andregulation whichinvolvesstandards setting,safetyreviewsandstudies,inspection oflicensedoperation and.enforcement ofNRCrules,andconfirmatory researchtoverifytheadequacyofregulations andrevealanyneedtoaugment,replaceorimprovethem.Iamenclosing forMissJohnston's information acopyofNRC's1975AnnualReportwhichcontainsacomprehensive presentation ofthisagency'sfunctions andcurrentactivities inregulating nuclearenergyuses,including nuclearpowerplants,onbehalfofthepublic.

1\TheHonorable EdwardHutchinson e,Theparticular incidenttowhichMiss'Johnston referswasaminoreventthatoccurredattheDonaldC.CooknuclearfacilityinBerrienCounty,Michigan.

Thefacilityconsistsoftwoseparatereactorunits,oneinoperation andtheotherunderconstruction.

OnMay10,1976,aslightincreaseabovetheverylowlevelofradioactivity normallypresentintheairwasdetectedintheauxiliary buildingforthefacility.

Thisbuildingisseparatefromthereactorcontainment buildings andhousessuchapparatus aswater-treatment systems,electrical systems,andthe"Emergency CoreCoolingSystem"(aback-upsystemtosupplycoolingwaterintheeventoflossofthenormalreactorcoolant).

Thecauseoftheriseinradioactivity wasleakagefromavalvewhichhadnotbeencompletely closedfollowing ascheduled shutdownofthereactorforroutinereinspection andmaintenance.

Theofficials attheplantthoughtitprudenttoevacuatetheauxiliary buildingatonce,duetotheincreaseinthelevelofairborneradioactivity..

Construction workersinthereactorbuildingunderconstruction heardthepublic-address announcement intendedtoapplyonlytothoseintheauxiliary building.

Theworkersevacuated thereactorbuilding, someofthemleavingthejobsiteentirely.

Itwasthataction,apparently, thatattracted mediaattention andledto.thenewspaper itemcitedbyMissJohnston.

radioactivity, andnooff-sitereleaseofradioactivity inexcessofregulatory limitsoccurred.

Thus,theincidentwasnotofthetypethatmustbereportedtotheNRC.Nevertheless, becauseofpublicinterestevokedbythemediacoverage, NRCwasnotified.

OnMayll, thenextday,anNRCinspector andanNRCradiation protection specialist visitedtheauxiliary buildingandconfirmed thatconditions werenormalandthattherehadbeennodangertothepublic.Plantofficials havetakenstepstoassurethatallvalveswillbesecuredandcheckedaftermaintenance andtoimprovecommunication withtheconstruction crewsatworkonthenewunit.Yourconstituent askswhatistopreventanoccurrence ofgreaterconsequence, ifthesekindsofincidents areallowedtooccur.Itisanunderstandable andvalidquestion, ofcourse, thoughIwouldpointoutagainthatthisparticular occurrence wasactuallyofnoconsequence tosafetyandthelicenseewouldhavelikedtopreventitonthebasisofeconomicoperation alone.TheNRC'sprimaryconcernisprotection ofpublichealthandsafetyagainstseriousaccidents, anda"defense-in-depth" conceptisrequiredandemployedinthe 0TheHonorable EdwardHutchinson

Yourconstituent willfinddetaileddescriptions oftheNRC'ssafetymeasuresconcerning powerreactorsinChapter2oftheenclosedAnnualReport.SincetheNRC'sfunctions relateprimarily toprotection ofpublichealthandsafety, nationalsecurityandenvironmental quality, wecanofferonlygeneralcommentconcerning HissJohnston's questions aboutthefutureofnuclearpowerandthecostofnuclearplants.TheEnergyResearchandDevelopment Administration, whichischargedwithdeveloping allpromising modesofenergytomeetnationalneeds, hasidentified coalandnuclearenergyasthemostrealistic alternatives tooilamongenergysourcespresently available andtechnically usable.Nuclearenergyalsoisprominent inrecentforecasts oftheFederalEnergyAdministration forthenexttwodecades.Detailsastotheexpenditure ofpublicfundsondevelopment ofnuclearplantsandfore-castsforallformsofenergycanbeobtainedfromthesetwoagencies.

Construction ofnuclearpowerplantshas, ofcourse, requiredbillionsofdollarsofinvestment byelectricutilities.Nevertheless, theirchoicesofgenerating sourceshavebeendictatedbyeconomics, andtheyhaveindicated thathighcapitalcostshavebeenoffsetbysavingsinnuclearfuelcosts.Moreinformation onfactorsinfluencing thisprivateinvestment maybeobtainedfromtheEdisonElectricInstitute, 90ParkAvenue,NewYork,NewYork10016.Inconclusion, IwouldnotethattheNRCneitherpromotesnoropposesnuclearpowerperse, andthatwesharetheconcernoftheCongress, otherFederalagenciesandthevastmajorityofscientists andengineers sTheHonorable EdwardHutchinson 4",',thatmembersofthepublic,suchasHissJohnston, begiventhemostcomprehensive andaccurateinformation available astheymaketheirJudgments concerning thefutureofnuclearenergy.Sincerety, WilliamJDircksAssistant ExecUtive Diredot.'or Operations
