IwanttoencouragetheNuclearRegulatoxyComnissiontoholdapublichearingonIndianaandMichiganPowerCo~y'sapplicationtoincreasenuclearwastestoragecapacityatitsCookplantinwesternMichigan.OurnationisinaperiodinwhichmanypeoplehavelostfaithintheirgovexnIrent'sresolvetodotherightthing,particularlyregardingnuclearpower.Andweshoulddoanyt1~gwecantohelprestorepublicconfidenceingovernmentandgivepeopletheopportunitytovoicetheiropinions.BecausepersonswithobjectionstotheCookplansinadvertentlywerenotnotifiedbytheNRC,theydidnothavetheopportunitytocallfor.ahearingatanearlierstage.Iamtold,however,thatpersonswithspecificobjectionscanaskforapublichearingwithin45daysaftertheplansarereviewedandapprovedbytheNRC.Ithinkyoushouldextendtheopportunitythatwasmissedearlierandmakeevexyefforttohearandconsiderallsidesinthisdecision.Nooneshouldbeabletofairlysaythattheregulatoryprocesswasashaminthiscase.Asyoumayknur,Ihavecalledforaoratoriumonnuclearpowerplantconstructionnotalreadyunderway.Iamconcernedaboutnuclearpowerplantaccidents,lmr-levelradiationandwaste.Ihaveseriousdoubtaboutourlong-termabilitytodealwiththedangerouswastegeneratedbythenuclearpowerplants.ButIhavenotca1ledforashutdownofoperatingnuclearpower-plantsorplantsunderconstruction,andIrealizewehavetostorethewastebeinggeneratedbytheseplants.Iunderstandtheneedtoexpandwastefacilities.Theonlyalternativewouldseemtobetransportationofthewastetoanotherstoragesite,andthatwouldbedangerousforanumberofreasons.Itdoesseemtomethatrequestsformarestoragespaceoonfixmmydoubtsaboutthenuclearpcmerplantindustxy'sabilitytosolvethewasteproblem.ConsumersPower,forexample,isaskingformrewastestoragespaceforitsMidland,Michigan,pcwerplantthatisstillunderconstruction.Mydoubtsaside,IthinktheCooksituationcallsforanextraeffort,bythegovernmenttoberesponsivetoitscitizens.Sincerely,Ogp~CarlLevinU.S.Senator IP4Qo~f IC'ARLLEVINMICNIOAN~JPnifebWfnfee&enableWASHINGTON.D.C.205I0May9,1979Mr.JosephM.HendrieNI.uclearRegulatoryComissionWashington,D.C.20555C9qcP~+V0ggoepo"0.

IwishtodirectyourattentiontoadevelopingsituationattheDonaldC.CookNuclearPlantinBridgman,Michigan.ThedetailsoftheproblemaresetforthinaletterdatedAugust24,l978,totheU.S.DepartmentofEnergy,acopyofwhichisenclosed.IntheeventthatR.R.S.Security,Inc.and/orIndianaMichiganPowerCompanydonotretainthecurrentsecurityforceofcompetentandexperi-encedemployees,theconsequencessetforthinmylettertotheDepart-mentofEnergywillberealized.Itisinconceivablethatafederalregulatoryagencyshoulddirectlyorindirectlyfoster,supportorcondoneanyactionwhichiscontraryto"federalpolicy"generally.Iwouldliketoassumethatgovernmentpoliciesintheareasoflaborrelations,fullemployment,equalrightsandothersarecoordinatedamongthefederalagencies.Itbegsthequestionforanyfederalagencytoassertthattheyhavenoauthoritytocorrectapendingproblemand/ortoreferthatproblemtoanotheragency.Whetherornotafederalagencyhasspecificstatutoryauthorityorjurisdictioninagivenarea,itisnonethelessinaposition'oinstituteremedialactionbythesheerapplicationof"federalpolicy".Thetimehascome,andtheDonaldC.CookNuclearPlantillustratestheproblem,forthefederalgovernmenttobebothconcernedandinvolvedwhereprivatecompaniescontravenevariousfederalpolicieswhileoperatingunderfederalcontrolandapproval.Uncheckedbiddingonfederallyregulatedprojectshasnumerousadverseconsequences.First,thereisunnecessarycosttothetaxpayerintermsofnewsecurityclearances,recruitmentandtrainingofemployees,unem-ploymentandwelfarecosts,andoverallfinanciallosstoacommunityintaxandconsumerdollars.Second,thereisperiltothesecurityofafacilityinthatcontinuityofoperationsisbrokenandformeremployeeswhohaveanintimateknowledgeofthefacilitytendtoremaininthecommunity.Third,thesituationisproductiveoflaborunrestcontrarytothemandateoftheNationalLaborRelationsActtopromoteandpreserveindustrialstability.And,finally,thelossandhardshipsufferedbyemployeesandtheirfamiliesisincalculable.~~~o/
