DearMr.GrobeThetransitiontotherevisedreactoroversightprocessattheDCCooknuclearplantwasdiscussedonFebruary15,

2000,atameetingatNRCheadquartersinRockville,Maryland.ThelicenseeproposedtoremainundertheNRCManualChapter0350processforthefirstfullyearafterrestartofUnit2andthenswitchtofullscaleimplementationoftherevisedreactoroversightprocess.TheNRCstaffcounter-proposedaphased-intransitiontotherevisedreactoroversightprocesswiththesignificancedeterminationprocessbeingusedforallNRCinspectionfindings,someoftheperformanceindicatorsbeingusedimmediatelyandtheremainderoftheperformanceindicatorsadoptedastheirtrailingdatabecameavailable.3iThereareadvantagesanddisadvantagestobothapproaches.Thelicenseeidentifiedaccuracyandresourceburdenproblemsassociatedwiththehistoricaldataneededformanyoftheperformanceindicators.TheNRCstaffidentifiedaproblemwithnothavingoversightdataforthepublicfollowingrestartofthemosttroubledplantintheUSinthepasttwoyears.'heconcernsofboththelicenseeandtheNRCstaffappearsincereandvalid.Itwouldbedifficulttoselecteitherapproachbecausethatwouldcausetheconcernsoftheunselectedpartytoremainunresolved.Fortunately,thereseemstobeacompromiseavailableDuringthepasttwoyears,thelicensee'sRestartActionPlanandtheNRCstaff'sManualChapter0350processprovidedassurancethatDCCookUnit2canberestartedwithadequatesafetymargins.It,wouldbereasonabletoassume,therefore,thatalltheseassessments,evaluations,tests,reviews,andinspectionsresultedinperformanceineachperformanceindicatorcategorybeingrestoredtotheGREENband.Ifnot,thelicensee'sSystemReadinessReviewsortheNRC'sinspectionstoclosetheconfirmatoryactionletterwouldhaveflaggednon-GREENperformance.Inotherwords,ifeitherthelicenseeortheNRCstaffhadanydoubtsthatperformanceinanyperformanceindicatorcategorywasnotGREEN,theplantwouldnotbereadyforrestart.Acceptingthisassumption'allowseveryperformanceindicatorintherevisedreactoroversightprocesstobeartificiallysettoGREENwhenDCCookUnit2entersMode2.Forexample,thescramperformanceindicatorcouldassumethattherehavebeenzeroscramsinthepast7,000criticalhoursandthealertandWashingtonOffice:1616PStreetNWSuite310oWashingtonDC20036-1495~202-3324900~FAX:202-3324905CambridgeHeadquarters:TwoBrattleSquareo.CambridgeMA02238-9105~617-547-5552~FAX:617-864-9405CaliforniaOffice:2397ShattuckAvenueSuite203~BerkeleyCA94704-1567~510-843-1872~FAX:510-843-3785tEB222000>D~dF9/og

February16,2000Page2of2notificationsystemperformanceindicatorcouldassumethat100%ofthesirenshavebeentestedsuccessfully.BysettingalloftheperformanceindicatorstoGREEN,thelicenseewouldnothavetowastetheresourcesrequiredtocollectandvalidatethehistoricaldata.ThelicenseewouldhavetoestablishthedatacollectionandreportinginfrastructurenecessarytoreporttheperformanceindicatorsquarterlybeginningattheendofthequarterinwhichDCCookUnit2entersMode2.ThisprocesswouldenabletheNRCstafftodemonstratetothepublicthatitwasachievingthegoalofmaintainingsafety.Beginningwiththequarterinwhichtheplantrestarted,theperformanceindicatorswouldaccuratelyinformthelicensee,theNRCstaff,andthepublichowtheplant'sperformancetrendedrelativetoaninitial"cleanslate."Atthesametime,theNRCstaffcouldfocusresourcesonverifyingthatDCCookUnit1isreadyforrestart.Thiscompromiseapproachhasitsfaults.Thelargestfaultisthatthestartingpointfortheperformanceindicatorsisselectedarbitrarilyandmaybenon-conservativelyhigherthanactualperformance.ButactualperformancecannotbepreciselydeterminedforsomeoftheperformanceindicatorsuntiloneormorequartersaAerrestart.ThearbitrarystartingpointonlycompromisessafetywhentheactualperformancelevelwouldbelowintheWHITEband,intheYELLOWband,orintheREDband.TheextensiveeffortsbythelicenseeandtheNRCstaffoverthepasttwoyearsprov'idereasontobelievethattheactualperformanceinalloftheperformanceindicatorcategoriesisGREENoratworstinthehighendoftheWHITEband.Theartificialstartingpointstracktoactualperformancelevelsatdifferentratesfortheperformanceindicators.SomePIswillreverttoactualperformancewithinaquarterortwowhilesomecantakeuptothreeyears.Thekeypointisthatalloftheperformanceindicatorswillaccuratelytrendrelativeperformancebeginningwiththeveryfirstquarter.DCCookUnit2willnotenterMode2unlessboththelicenseeandtheNRCstaffbelievethatsafetymarginsinalloftheperformanceindicatorcategorieshavebeenadequatelyrestored.ThePIswouldthereforerevealwhere,ifany,erosionsfromthatconditionhaveoccurredfollowingrestart.ItseemsbettertousetherevisedreactoroversightprocessinitsentiretyimmediatelyuponrestartofDCCookUnit2thantopostponeitsuseforafullyearasproposedbythelicenseeortoonlyusesomeoftheprocessasproposedbytheNRCstaff.ThenuclearindustryandtheNRCstaffhavetoutedtherevisedreactoroversightprocessasTHEmonitoringprogramforthenewmillenium.TheNRCshoulduseitsbesttoolattheworstplant.ArtificiallysettingalloftheperformanceindicatorstoGREENwouldbesomewhatunfairtootherlicenseeswhohaveearnedallGREENsthroughoperationalperformance.ButIdoubtthatanylicenseewouldtradeplaceswithDCCook'slicenseejusttoearna"freeticket"toGREENperformanceindicators.Sincerely,DavidA.LchbaumNuclearSafetyEngineer E
