OYSTER CREEK NUCLEAR GENERATING STATION - NRC INDEPENDENT SPENT FUEL STORAGE SECURITY INSPECTION REPORT NO.

07200015/2021402 AND SECURITY DECOMMISSIONING INSPECTION REPORT 05000219/2021404

Dear Ms. Sterdis:

On August 10, 2021, the U.S. Nuclear Regulatory Commission (NRC) completed both an Independent Spent Fuel Storage Installation (ISFSI) security inspection and a decommissioning security inspection at the permanently shut down Oyster Creek Nuclear Generating Station (Oyster Creek) in Forked River, New Jersey. On-site inspection was conducted from August 9 - 10, 2021. The ISFSI inspection covered the licensees physical security plan, Revision 0 and NRC Order EA-02-104 dated October 16, 2002, Additional Security Measures. The ISFSI inspection was conducted using NRC Inspection Procedure 81311, Physical Security Requirements for Independent Spent Fuel Storage Installations.

The decommissioning inspection covered the licensees physical security plan Revision 21 and was conducted using NRC Inspection Procedure 81200.02, Access Control for Decommissioning Nuclear Power Reactors.

The enclosed inspection report documents the inspection results, which were discussed with Mr. Jeffrey Dostal, Site Vice President, and other members of your staff, on August 10, 2021.

The inspection examined activities conducted under your license as they relate to security and compliance with the Commissions rules and regulations and with the conditions of your license.The inspectors reviewed selected procedures and records, observed activities, and interviewed personnel.

Enclosure contains Sensitive unclassified Non-Safeguards Information. When separated from enclosure, the transmittal document is decontrolled. Based on the results of this inspection, the inspectors documented three violations of very low security significance, Severity Level (SL) IV, involving violations of NRC requirements in this report. The NRC is treating these violations as Non-Cited Violations (NCVs) consistent with Section 2.3.2.a of the Enforcement Policy. The current Enforcement Policy is available on the NRCs Web site at http://www.nrc.gov/about-nrc/regulatory/enforcement/enforce-pol.html.

In accordance with Title 10 of the Code of Federal Regulations (10 CFR) 2.390, Public Inspections, Exemptions, Requests for Withholding, of the NRC's "Rules of Practice," a copy ofthis letter and enclosure will be available electronically for public inspection in the NRCs Public Document Room or from the Publicly Available Records (PARS) component of the NRC's Agencywide Documents Access and Management System (ADAMS). ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room).

However, the material enclosed herewith contains Security-Related Information in accordance with 10 CFR 2.390(d)(1) and its disclosure to unauthorized individuals could present a security vulnerability. Therefore, the material in the enclosure will not be made available electronically for public inspection in the NRC Public Document Room or from NRC's ADAMS. If you choose to provide a response and Security-Related Information is necessary to provide an acceptable response, please mark your entire response Security-Related Information-Withhold from public disclosure under 10 CFR 2.390 in accordance with 10 CFR 2.390(d)(1) and follow the instructions for withholding in 10 CFR 2.390(b)(1). In accordance with 10 CFR 2.390(b)(1)(ii), the NRC is waiving the affidavit requirements for your response.
