U.S. NUCLEAR REGULATORY COMMISSIONS ANALYSIS OF HOLTEC DECOMMISSIONING INTERNATIONALS DECOMMISSIONING FUNDING STATUS REPORT FOR OYSTER CREEK NUCLEAR GENERATING STATION, INDIAN POINT GENERATING STATIONS, AND PILGRIM NUCLEAR POWER STATION (DOCKET NOS 50-219, 50-3, 50-247, 50-286, AND 50-293)
Dear Jean Fleming:
By letter dated March 25, 2022, the U.S. Nuclear Regulatory Commission (NRC) received your decommissioning funding status (DFS) report (Agencywide Documents Access and Management System (ADAMS) Accession No. ML22084A059) for the Oyster Creek Nuclear Generating Station (Oyster Creek), the Indian Point Generating Stations, Units 1, 2, and 3 (IPEC), and the Pilgrim Nuclear Power Station (Pilgrim).
The NRC has reviewed and analyzed the site-specific decommissioning cost estimates for these facilities, as required by Title 10 of the Code of Federal Regulations (10 CFR), Paragraph 50.82(a)(4)(i), Termination of license - For power reactor licensees. The NRC also verified the amount(s) stated within the licensees decommissioning trust funds for Oyster Creek, IPEC, and Pilgrim as of December 31, 2021, as well as earnings assumptions.
Based on the reported decommissioning trust fund balances as of December 31, 2021, of $593 million in 2021 dollars for Oyster Creek, $655 million for Indian Point 1, $786 million for Indian Point 2, $931 million for Indian Point 3, and $825 million for Pilgrim, together with earnings credits specified under NRC regulations, the NRC has determined that as of December 31, 2021, Holtec Decommissioning International, LLC (HDI), is providing the funds necessary to meet decommissioning funding assurance requirements at the sites. HDI has funding in place to meet the radiological decommissioning expenses to achieve license termination at the sites and in addition, as each of these facilities has an exemption for use of the decommissioning trust for managing spent fuel, NRC has also concluded that HDI is providing the funds necessary to meet the spent fuel management requirements of each site.
This letter confirms the correspondence, described above, regarding DFS reports for permanently shut down power reactors as required under 10 CFR 50.82(a)(v) - (vi). As of the date of this letter, considering the available information, the NRC has determined that HDI has November 2, 2022
J. Fleming satisfied the decommissioning funding assurance requirements of 10 CFR 50.82 Termination of License, for Oyster Creek, IPEC, and Pilgrim as of December 31, 2021.
In accordance with 10 CFR 2.390, Public inspections, exemptions, requests for withholding, of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs ADAMS.
