OYSTER CREEK NUCLEAR GENERATING STATION - LICENSE TERMINATION PLAN ACCEPTANCE REVIEW REQUEST FOR SUPPLEMENTAL INFORMATION (EPID L-2024-LLA-0107)

Dear Mr. Trice:

On August 1, 2024, Holtec Decommissioning International, LLC (HDI) submitted a license amendment request (LAR) (Agencywide Documents Access and Management System (ADAMS) Accession No. ML24214A037) proposing approval of the License Termination Plan (LTP) for Renewed Facility Operating License No. DPR-16 for the Oyster Creek Nuclear Generating Station (OCNGS). This request also proposes to add a license condition that would establish the criteria for determining when changes to the LTP require prior U.S. Nuclear Regulatory Commission (NRC) approval. In addition, HDI identified two technical support documents for the OCNGS LTP LAR that are currently under development and will be submitted for review on or before October 31, 2024.

During the acceptance review of the OCNGS LTP, the NRC staff determined that supplemental information is essential for the staff to complete its detailed safety and environmental review in a timely manner. The staff found that characterization information, as well as other key information was incomplete. Site characterization is critical in multiple aspects of the staffs LTP application evaluation. One of the objectives of site characterization, as an example, is to provide input for the final status survey design to demonstrate compliance with cleanup regulations. As another example, site characterization is used to determine whether the input to pathway analysis/dose or risk assessment models for determining site-specific clean up criteria is acceptable. If the licensee does not provide adequate characterization information in the LTP application, it may likely lead to significant delays and unnecessary use of time and resources.

Please provide the requested supplemental information no later than March 31, 2025. The staff will evaluate them upon receipt. Consistent with division policy and procedure, the staff is providing approximately 6 months for HDI to provide request for supplemental information (RSI) responses due to the time it may take to obtain the needed information and provide a complete submittal of high quality. Some of the response may require collection of additional data, laboratory evaluation, or obtaining qualified resources to perform assessments, such as a cultural and historical survey.October 4, 2024 K. Trice 2 In addition, Enclosure 2, Issues Pending Requests for Additional Information (RAIs), discusses issues that will most likely result in formal RAIs, should the NRC accept your LTP amendment request. This information is being provided to you to assist in the assemblage of efficient responses should formal RAIs in these areas become necessary. No responses to the pending RAIs in Enclosure 2 are necessary at this time; however, you may elect to submit supplemental information to address them before March 31, 2025. We will evaluate them, upon receipt. Also, we will evaluate upon receipt, as part of the acceptance review, the two technical basis documents that HDI committed to submit by October 31, 2024.
