APPENDIX A NOTICE OF VIOLATION PECO Energy Company Docket No. 50-277/278 Peach Bottom Atomic Power Station Unit 2 and 3 License No. DPR-44 Delta, PA DPR-56 ,

( During an NRC inspection conducted betwe' luly 7 and September 7,1996, a violation of NRC requirements was identified. In acco. .nce with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1996), the violation is listed below:

l 10 CFR 50.59 requires, in part, that PECO prepare and maintain written safety evaluations that provide the bases for the operation of systems, different than as described in the updated Final Safety Analysis Report (UFSAR), to ensure that an unreviewed safety question does not exist. The Peach Bottom UFSAR states,in part, in Sections 5.3.4, i l 9.4.4.4, and 14.9.1.2, that the Standby Gas Treatment (SBGT) system; 1) may be operated to maintain a negative pressure in the reactor building, whenever the normal reactor building ventilation system is isolated and 2) shall maintain the reactor building pressure at a negative 1/4 inch water gauge pressure with a flow rate of not more that 10,500 cfm, following a design basis accident, in the event of a postulated single failure.

Contrary to the above, prior to January 1996, PECO had not prepared or maintained a written safety evaluation that provided the bases for the operation of the Standby Gas j Treatments system, different than as described in UFSAR Sections 5.3.4, 9.4.4.4, and '

14.9.1.2, to ensure that an unreviewed safety question did not exist. Specifically, operations procedures allowed conditions where the SBGT system; 1) was operated to maintain negative pressure in the reactor building, when the normal reactor building l ventilation system was not isolated, and 2) due to fan operating alignments, could not i maintain the reactor building at a negative pressure of 1/4 inch water gauge pressure with

! a flow rate of not more than 10,500 cfm, following a design basis accident, in the event of a postulated single failure.

In accordance with the NRC Enforcement Policy and because of PECO's proper response to NRC Unresolved item 95-27-02, as documented in PECO's February 28,1996, letter, no additional response to this violation is necessary. However, PECO may respond, if desired, to clarify any issues discussed in the Notice of Violation or in the body of the attached Inspection Report 96-06.
