I Docket No. 50-275 l

l EVALUATION OF REQUEST FOR EXTENSION OF lHe CONSTRUCTION FERN!T FOR lH I DIAeLO CANYON NUCLt AR F07.tR PLAE UNIT-i introduction l

On May 25, -i976, Pacific Gas and Electr!c Company (PG&E) filed a request l

for en extension of the completion date of Construction Permit No. CPPR-39 l

from Jul y 1,1976 to January 1,1977. In the request for extension, PG&E stated that additional time would be required to evaluate the plant's l

capability to withstand an earthquake on the Ibsgri f ault and to concl ude ,

l the 1icensing process.

Discussion 1

The Constrt, ction Permit for Unit I, CPPR-39, was issued on April 23, 1968 and was last modi fied by the Commission's Order dated February 25, 1976, which extenced the latest completion date to July 1,1976. j l ,

in the application for extension PG&E stated that on April 29,1976 the j United States Geological Survey (USGS) issued its review of the geological  !

and seismolcgic data relevant to the Diablo Canyon Units in which it was  !

concluded inat an eartnquake occurring anywhere along the Fbsgri Fault .

should be censidered in addition to those earthquakes previously censidered l in the design of the units. On May ll, 1976 the Commission's Staff issued l Supplement %. 4 to the Safety Evaluation Report which specified an ef fective horizontal ground acceleration to be used for the development of design response spectra for the plant based upon the earthquake postulated by the '

USGS.

PG&E f urther stated that additional time will be required to permit PG&E to evaluate the plant's capability to withstand the new earthquake, for the Commission to review and eval uate PG&E's work, and to concl ude the licensing process. Accordingly, PG&E requested a six months' extension of Construction Permit No. CPPR-39 to change the latest completion date from July 1,1976 to Januery 1,1977. ,

Conclusion The Commission's Staf f has reviewed the information provided in the applicant's submittal, and we conclude that the f actors discussed above are reasonaDie and constit.te good cause for delay; and that extension of construction of Unit I for six months is justifiable, i

As a result of the staf f's review of the Final Safety Analysis Report' to date, and c:7sidering the nature of the delays, we have identif!ed no area of significant safety considerations in connection with the extension of the construction permit completion dates for Diablo Canyor. Unit 1.

The staf f finds that this action does not involve a significant hazceds consideration, and that good cause exists for the issuance of an Order extending t e completion date, Accordingly, issuence of an Order extending the latest completion date for constructic . of Diaolo Canyon Uni t 1, as set forth in CPPR-39, to January 1, 1977 is reesonaDie and should be authorized.
