% / M s,....+/ OF M 1985 MEMORANDUM FOR: Illinois File FROM: Joel 0. Lubenau Senior Project Manager State Agreements Program Office of State Programs

SUBJECT:

AMENDMENTS TO ILLIN0IS STATUTES On August 11 and 19, 1986 Betsy Salus, Staff Attorney, IDNS 'provided copies of amendments to Illinois statutes which pertain to the proposed section 274b Agreement (enclosures 1 and 2). These were reviewed by OSP and OGC staffs and no problems were noted with respect to a section 274b Agreement.

0GC and OSP staffs noted the authorization in section 216a.(6) of the Radiation Protection Act related to establishing differential exposure limits based upon age. Such limits are authorized but not mandated, hence no compatibility problem arises unless Illinois attempts to implement this provision. Note was also made of the revised provisions in the Lcw-L3 vel Radioactive Waste Management Act in section 241-13 regarding fees paid by low-level radioactive waste (LLW) generators. As part of the State's waste management program, fees will be collected from LLW generators on a volume basis except for nuclear power reactors possessing OL's which will pay an annual fee.
