  • l ENCLOSURE 1 NOTICE OF VIOLATION PECO Energy Company Docket Nos. 50-277,278 Peach Bottom Atomic Power Station Units 2 and 3 License Nos. DPR-44, DPR-56 Delta, PA )

During NRC inspections and an investigation conducted from March 9,1998, through December I 22,1998, a violation of NRC requirements was identified. In accordance with the " General I Statement of Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the violation is listed below:

10 CFR 55.59(a)(1) requires, in part, each licensee shall successfully complete a requalification program developed by the facility and shall be conducted for a continuous period not to exceed 24 months.

10 CFR 55.57(a)(4) requires, in part, that the applicant for renewal of a license shall provide a statement by an authorized representative that during the effective term of the current license the applicant has successfully completed the requalification program for the facility fcr which the license is being sought. Also,10 CFR 55.9 requires, in part, that information provided to the commission by an applicant for a license or a licensee, shall be complete and accurate in all i material respects.

Contrary to the above, the NRC identified that three licensed operators failed to successfully ,

complete the requalification program developed by the facility during the licensee requalification '

training period which was conducted from April 1994 through March 1996. Specifically, during that cycle, the operators were absent from training in the subject areas of technical specifications, normal and emergency operating procedures, and plant systems and had not made up the missed training, in some instances, until April 1998. Due to the missed training, the requalification program in these cases was not completed when the 24 month training period ended in March 1996.

Additionally, and as a result of the missed training, one operator license renewal application (NRC Form 398), signed by the operator and authorized licensee representatives on October 4, 1996, was submitted to the NRC and was inaccurate regarding certification of the applicant having met the approved requalification program during the effective term of the then current operator license (Docket No. 55-61210). Specifically, NRC Form 398 certified, in part, that the applicant had met the approved requalification program as required by 10 CFR 50.54(1-1) and had therefore successfully completed the program when in reality the operator had not made up training as noted above.

This is a Severity Level IV violation (Supplement I) l The NRC has concluded that information regarding the reason for the violation, the actions

taken and planned to correct the violation and prevent recurrence, and the date when full compliance was achieved is already adequately addressed in this inspection report. However, you are required to submit a written statement or explanation pursuant to 10 CFR 2.201 if the description therein does not accurately reflect your corrective actions or your position.
