OF MEETING HELD ON MARCH 6, 1987 CONCERNING LOW-LEVEL.
, WASTE MANAGEMENT AT MAINE YANKEE-ATOMIC POWER STATION
- The above meeting was held in Bethesda, Maryland, and the names of the attendees 4 are. listed in Enclosure 1. Enclosure 2. lists specific points made at the meeting. Enclosure 3 contains a. copy of material included in Maine Yankee Atomic Power Company's (MYAPCo) presentation. Enclosure.4 is a document thet was presented by MYAPCo as a conceptual overview of the proposal for In-Situ i
Deconmissioning/ Low Level Waste Management.
Representatives of MYAPCo presented a concept which involves'(1) storing all of the State of Maine's low-level radioactive waste along with.the plant's low-level-waste in a temporary storage facility at the Maine. Yankee site.
4 until the termination of the plant's operating license (October 21, 2008);
j (2) decommissioning the plant (2009-2011) and preparing the containment building
- for use as an active low-level waste repository;-(3) . operating the decommissioned 3
containment building as a state-owned low-level waste site for receipt of all low-level waste generated in Maine (2012-2041); and (4) permanently closing the
, low-level waste site (2042).
- - The MYAPCo representative indicated that their next step was to present this i
concept to the State of Maine's Low-level Waste Commission for its approval.
. If approved by that Commission, the concept would have to be approved by-
] the voters in the State, according to State law, in order to be implemented.
The NRC staff indicated to the MYAPCo representatives that, although there are
, many technical issues that need resolution, principal concerns at-this stage
! relate to the policy, legal, and regulatory-implications of such a concept.
i The staff noted the potential precedent-setting nature of such a proposal and i identified several policy issues that would need to be addressed before the i NRC could_ consider the proposal. Some of these concerns are presented in p Enclosure 2.

Enclosure 2 NRC COMMENTS o It was stated that endorsement by NRC was not possible without a detailed submittal from Maine Yankee Atomic Power Company (MYAPCo),
followed by an NRC review and exploration of policy, legal, and 4 technical issues.
o The potential impact of this proposal on the low-level waste activities of other states is unclear.
o The use of the containment building for low-level waste disposal may be inconsistent with NRC's decommissioning rule. The link between low-level waste management and decommissioning generates questions about legal implications, current policies, and rules. -
o This proposal appears to be inconsistent with NRC several policies or regulations. For instance, a low-level waste disposal system should not require long-term " active" maintenance such pumping and treatment of water from a desposal unit. Such policies or regulations would have to be considered by the applicant.
o There are many unanswered questions, such as how this proposal affects decommissioning of the plant, and what manpower and detailed tasks are required to maintain the facility.
4 o MYAPCo's proposed feasibility study should be presented to the NRC Commissioners prior to the initiation of an in-depth NRC staff effort.
o The NRC staff suggested the term " Topical Report" used on the report was an inappropriate term for this document in view of NRC review procedures.
MYAPCo COMMENTS o Waste would be packaged to meet requirements for burial at commercial disposal facilities.
o MYAPCo does not foresee large amounts of hazardous waste (chemicals or biological materials mixed with radioactive waste) being stored at the site in the future.
o The NYAPCo representative indicated that they would consider disposing of greater than Class C wastes although the Low-Level i Radioactive Waste Policy Amendments Act of 1985 specifies that 3
disposal of greater than Class C waste is a responsibility that may be assumed by the federal government.
o Funds saved from not dismantling the containment building would be placed in a trust to cover the cost of monitoring the low-level waste facility.
