ENCLOSURE 1 NOTICE OF VIOLATION PECO Energy Company Docket Nos. 50 277/278 Peach Bottom Atomic Power Station Units 2 and 3 License Nos. DPR 44, Delta, PA DPR 56 During an NRC inspection conducted between September 21 and November 22,1997, a violation of NRC tequirements was identiflod. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG 1600,tho violation is listed below:

Technical specification 5.4.1 requires, in part, that written procedures be establishea, implemented, and maintained covering the applicable procedures recommended in Regulatory Guide 1.33, Appendix A, November 1972. The procedures lis;ed in Regulatory Guide 1.33, Appendix A, Mclude those covering procedure adherence, t,quipment maintenance, startup of DC electrical systems and general plant scram recovery.

Contrary to the above, F5CO did not properly implement written procedures on three separate occasions, specifically:

A. On multiple occasions between July and September 22,1997, personnel did not follow the instructions for work order CC t 74600, resulting, in part, in electrically un::oupling the unblocked, safety celated 3B HPSW pump versus the non safety related SW pump as specified in the work order.

B. On November 9,1997, an equipment operator did not follow system operating procedure SO 578.1.A 2,"125/250 Volt Station Rattery Charger Startup" for starting the Unit 2A 2 safety related station battery charger, which resulted in a Unit 2 reactor scram.

C. From November 9, '997, to November 11,1997, while executing a Unit 2 cooldown t.ubsequent to a scram, licensee personnel faiteu to perform Section 3.0 of ST O 0800-500 2," Recording and Monitoring Reactor Vessel Temperatures and Pressures;" in that they did not complete nor document the required prerequisites before proceeding with subsequent steps in the procedure as required.

This is a Severity Level IV violation (Supplement i).

Pursuant to the provisions of 10 CFR 2.201, PECO Energy Company is ' ,tby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Admirdstrator,9egion 1, and a copy to the NRC Resident inspector at the f acility that is the subject of this Notice, within 30 days of receipt of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of Viola.

Your response may reference or include previous docketed correspondence, if the correspondence adequately addresses the required response. Where good cause is shown, consideration will be given to extending the response tirne.

Decause your response will be placed in the NRC Public Document Room (PDR), to the evtent possible, it should not include any personal privacy, proprietary, or sateguards information so that it can be placed in the PDR without redaction. If personal privacy or proprietary information is necessary to provide an acceptable response, then please provide a bracketed copy of your response that identifies the information that should be protected and a redacted copy of your response that deletes such information. If you request withholding of such material, you muit specifically identify the portions of your response  ;

that you seek to have withheld and provide in detail the basis for your claim of withholding (e.g., explain why the disclosure of information will create an unwarranted li,vasion of personal privacy or provide the information required by 10 CFR 2.790(b) to support a request for withholding confidential commercial or financialinformation), if safeguards information is necessary to provide an acceptable response, please provide the level of protection described in 10 CFR 73.21.
