ORDER EXTENDING THE EFFECTIVENESS OF THE APPROVAL OF THE TRANSFER OF THE POSSESSION ONLY LICENSE FOR THE LA CROSSE BOILING WATER REACTOR FROM LACROSSESOLUTIONS, LLC TO DAIRYLAND POWER COOPERATIVE AND CONFORMING AMENDMENT (CAC NO. 000083; EPID-L-2020-LLO-0004)

Dear Mr. Sauger:

The U.S. Nuclear Regulatory Commission (NRC) is issuing the enclosed Order in response to your request dated June 24, 2020 (Agencywide Documents Access and Management System Accession No. ML20188A228), on behalf of LaCrosseSolutions, LLC for an extension of the effectiveness of an NRC Order dated September 24, 2019.

That Order approved the transfer of Possession Only License No. DPR-45, held by LaCrosseSolutions, LLC, for the La Crosse Boiling Water Reactor (LACBWR) to the Dairyland Power Cooperative, and approved a conforming license amendment in accordance with Section 50.80, Transfer of licenses, and Section 50.90, Application for amendment of license, construction permit, or early site permit, of Title 10 of the Code of Federal Regulations. The Order was intended to be implemented upon the completion of decommissioning activities at the LACBWR site and was effective for 1 year from its date of issuance.

The NRC staff has considered the information presented in your June 24, 2020, request and determined that you have shown good cause for extending the effectiveness of the Order from September 24, 2020, to March 24, 2021. The enclosed Order approves this extension. The previously approved conforming license amendment will be issued and made effective when the transfer is complete.

The NRC Safety Evaluation enclosed with the September 24, 2019, Order remains valid. This Order is being forwarded to the Office of the Federal Register for publication.
