LaCrosseSolutions LC-2021-0012 Page 2 of2 By letter dated June 27, 2018 (Reference 1), as supplemented by letter dated December 3, 2018 (Reference 2), LaCrosseSolutions, LLC (LS) and Dairyland Power Cooperative (DPC) submitted an application requesting U.S. Nuclear Regulatory Commission (NRC) consent for the direct transfer ofLS's Possession Only License No. DPR-45, for the La Crosse Boiling Water Reactor (LACBWR), to DPC.

Specifically, LS and DPC requested that the NRC consent to the transfer ofLS's NRC-licensed possession, maintenance, and decommissioning authorities back to DPC upon the completion of decommissioning activities at the LACBWR site. LS and DPC also requested approval of a conforming amendment to the license pursuant to 10 CFR 50.80 and 10 CFR 50.90.

Upon completion of its review, the NRC issued an Order providing consent of the proposed license transfer, subject to the condition described in the order, and approval of the conforming license amendment (Enclosure 1 to Reference 3). The Order states, in part, that should the proposed direct license transfer not be completed within one year of the Order's date of issuance, the Order shall become null and void; provided, however, that upon written application and for good cause shown, such date may be extended by order.

By letter dated June 24, 2020 (Reference 4), LS submitted a request for an extension of the effectiveness of the NRC Order dated September 24, 2019. The NRC issued an Order approving the extension of the effectiveness of the Order from September 24, 2020, to March 24, 2021 (Enclosure to Reference 5). By letter dated February 2, 2021 (Reference 6), LS submitted a second request to extend the effectiveness of the NRC Order by an additional six months. The NRC issued an Order approving the extension of the effectiveness of the Order from March 24, 2021, to September 24, 2021 (Enclosure to Reference 7).

The purpose of this letter is to request that the effectiveness of the order approving the transfer oflicense and conforming amendment be extended twelve months. The extension would allow sufficient time to complete decommissioning activities.

There is good cause to extend the existing approval. Responses to requests for additional information regarding Final Status Survey Final Reports (FSSRs) and their associated Release Records are currently under review by NRC staff. Based on the current status of the NRC review, it is anticipated that additional time will be needed to address any questions or potential issues identified by the NRC during review of the responses to the Request for Additional Information and the revised FSSRs. The extension would allow adequate time for response development by LS regarding any additional questions or potential issues. In addition, it provides the NRC staff with additional time to assess the responses provided by LS and make a final determination regarding the release of land for unrestricted use.

In accordance with 10 CFR 50.91(b)(l), a copy of this submittal has been sent to the State of Wisconsin.
