ORDER EXTENDING THE EFFECTIVENESS OF THE APPROVAL OF THE TRANSFER OF THE POSSESSION ONLY LICENSE FOR THE LA CROSSE BOILING WATER REACTOR FROM LACROSSESOLUTIONS, LLC TO DAIRYLAND POWER COOPERATIVE AND CONFORMING AMENDMENT (EPID-L-2020-LLO-0004)

Dear John Sauger:

The U.S. Nuclear Regulatory Commission (NRC) is issuing the enclosed Order (Fifth Extension Order) in response to LaCrosseSolutions, LLCs request dated November 23, 2022 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML22335A085), for a fifth extension of the effectiveness of a U.S. Nuclear Regulatory Commission (NRC) Order dated September 24, 2019 (Transfer Order) (ML19008A393), from the current December 24, 2022, expiration date until March 24, 2023.

The Transfer Order approved the transfer of Possession Only License No. DPR-45, held by LaCrosseSolutions, LLC, for the La Crosse Boiling Water Reactor (LACBWR) to Dairyland Power Cooperative and approved a conforming license amendment in accordance with Section 50.80, Transfer of licenses, and Section 50.90, Application for amendment of license, construction permit, or early site permit, of Title 10 of the Code of Federal Regulations (10 CFR). The Transfer Order was intended to be implemented upon completion of decommissioning activities at the LACBWR site and was effective for 1 year from issuance.

By letter dated June 24, 2020 (ML20188A228), LaCrosseSolutions, LLC submitted a request to extend the effectiveness of the Transfer Order by 6 months. By Order dated September 1, 2020 (First Extension Order) (ML20195A846), the Commission extended the Transfer Orders expiration date to March 24, 2021. By letter dated February 2, 2021 (ML21036A055),

LaCrosseSolutions, LLC submitted a request to extend the effectiveness of the Transfer Order by an additional 6 months. By Order dated March 9, 2021 (Second Extension Order)

(ML21050A299), the Commission extended the Transfer Orders expiration date to September 24, 2021. By letter dated August 17, 2021 (ML21230A330), LaCrosseSolutions, LLC submitted a request to extend the effectiveness of the Transfer Order by an additional 12 months. By Order dated August 30, 2021 (Third Extension Order) (ML21228A105), the Commission extended the Transfer Orders expiration date to September 24, 2022. By letter

J. Sauger dated August 16, 2022 (ML22230A801), LaCrosseSolutions, LLC submitted a request to extend the effectiveness of the Transfer Order by an additional 3 months. By Order dated September 9, 2022 (Fourth Extension Order) (ML22235A792), the Commission extended the Transfer Orders expiration date to December 24, 2022.

The NRC staff has considered the information presented in the November 23, 2022, request and determined that LaCrosseSolutions, LLC has shown good cause for extending the effectiveness of the Transfer Order by an additional 3 months from December 24, 2022, to March 24, 2023. The enclosed Fifth Extension Order approves this extension. The previously approved conforming license amendment will be issued and made effective when the transfer is complete. The NRC staffs safety evaluation enclosed with the September 24, 2019, Transfer Order remains valid. The Fifth Extension Order is being forwarded to the Office of the Federal Register for publication.

In accordance with 10 CFR 2.390, Public inspections, exemptions, requests for withholding, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs ADAMS.
