NOTICE OF VIOLATION Mr. Michael D. Nevers IA 96-048 During an NRC investigation conducted by the NRC Office of Investigations (0I Report No. 3-96-007), a violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the violatior, is set forth below:

1 10 CFR 50.5 provides, in part, that any employee of a licensee who (1) engages in deliberate misconduct that causes a licensee to be in violation of any rule, regulation, or order, or any term condition, or limitation of any license, issued by the Commission, or (2) deliberately submits to the NRC or licensee information that the person submitting the information knows to be incomplete or inaccurate in some respect material to the NRC may be subject to enforcement action in accordance with 10 CFR Part 2, Subpart B.

10 CFR Part 50, Appendix B, Criterion V, " Instructions, Procedures, and Drawings," requires that activities affecting quality be prescribed by documented instructions and procedures and be accomplished in accordance with these instructions and procedures.

Procedure DB-ME-04100, " Emergency Lighting System Test," Revision 05, Step 8.1.3.b.3, requires performance of a 90-second burn test for each emergency lighting unit while monitoring battery discharge voltage. Step 8.1.3.b.4 requires that following the test, note either satisfactory performance, or the problem and Work Request written, in the designated space at the bottom of the data sheet.

Contrary to the above, on January 8,1996, Mr. Michael D. Nevers, a Nuclear Electrician Journeyman at the Toledo Edison Company (licensee) Davis-Besse l Nuclear Plant, engaged in deliberate misconduct by deliberately falsifying on the data sheet for Procedure DB-ME-04100 that he had satisfactorily completed a 90-second burn test for six emergency lighting units located in the control i room. Step 8.1.3.b.3 of Procedure DB-ME-04100 required performance of a 90-second burn test for each emergency lighting unit while monitoring battery discharge voltage. However, Mr. Nevers was in the control room less than five minutes, an insufficient amount of time to properly test all six units, and subsequently admitted that he sometimes did not perform the full 90 second test. The inaccurate information was material to the NRC because the licensee used the information to demonstrate that the safety-related work associated with Procedure DB-ME-04100 had been accomplished in accordance with the requirements of 10 CFR Part 50, Appendix B, Criterion V. (01014)

This is a Severity Level IV violation (Supplement I).
