NOTICE OF VIOLATION Toledo Edison Comoany Docket No. 50-346 As a result of the inspection conducted on January 1, through February 15, 1988, and in accordance with the "General Policy and Procedures for NRC Enforcement Actions," 10 CFR Part 2, Appendix C, the following violation was identified:

Technical Specification 3.3.3.3 requires that the seismic monitoring instrumentation shown in Table 3.3-7 (which includes the seismic trigger) shall be operable at all times.

For the seismic trigger to be operable it must meet the frequency response requirements shown in Table 3.3-7.

Action statement a. of Technical Specification 3.3.3.3 requires that with one or more seismic monitoring instruments inoperable for more than thirty days, the licensee shall prepare and submit a Special Report to the Commission within the next ten days outlining the cause of the malfunction and the plans for restoring the instrument to operable status.

Contrary to the above, on January 6, 1988, the licensee discovered that it had installed a seismic trigger on June 25, 1977, which did not have the frequency range response that is required by Table 3.3-7, and did not restore the seismic trigger to operability within thirty days, and did not, within the next ten days, submit a Special Report to the Commission outlining the cause of the malfunction and the plans for restoring the seismic trigger to operable status.

This is a Severity Level V violation (Supplement I).

The inspection showed that action had been taken to correct the identified violation and to prevent recurrence.

Consequently, no reply to the violation is required and we have no further questions regarding this matter.
