NOTICE OF VIOLATION Toledo Edison Company Docket No. 50-346 Davis-Besse NPS License No. NPF-3 During an NRC inspection conducted on October 25, 1994, through December 8,1994, a violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1994), the violation is listed below:

10 CFR Part 50, Appendix B, Criterion V, " Instructions, Procedures, and Drawings," states, in part, that " Activities affecting quality shall be prescribed by documented instructions, procedures, or drawings ... and shall be accomplished in accordance with these instructions, procedures, or drawings."

Administrative procedure DB-MN-00005, Foreign Material Exclusion (FME),

defined an exclusion zone 3 as an area requiring access control over personnel and materials. This, in part, was accomplished via use of a material accountability log. The licensee specified the reactor cavity / refuel canal area as an exclusion zone 3 area.

Administrative procedure DB-MN-00005 also required that a closeout inspection be conducted whenever working in the vicinity of open fluid systems or in other open components where foreign material left inside could cause damage or equipment failure.

Contrary to the above, an FME closeout inspection of the reactor cavity / refuel canal was not adequately done following completion of refueling activities and reassembly of the reactor on or about October 26, 1994. The closeout inspection requirement was incorrectly determined to not be applicable. In addition, during that same time, the FME material accountability log indicated that plastic bags and a clipboard were unaccounted for. However, plant personnel were unaware of.this because a review of the log had not been done. Procedures did not require the log to be reviewed nor any discrepant entries to be reconciled.

This is a Severity Level IV Violation (Supplement I).

The inspection showed that action had been taken to correct the identified violation and additional action was in process to prevent recurrence.

Consequently, no reply to this violation is required and we have no further questions regarding this matter.
