NOTICE OF VIOLATION Toledo Edison Company Docket No. 50-346 As a result of the inspection conducted between January 16 and February 28, 1989, and in accordance with the " General Policy and Procedures for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1988), the following violations were identified:
1.
Technical Specification 6.8.4 requires that certain programs shall be established, implemented, and maintained.
One of the programs required is a program to reduce leakage from those portions of systems outside containment that could contain highly radioactive fluids during a serious transient or accident to as low as practical levels.
The program shall include integrated leak test requirements for each system at refueling cycle intervals or less.
The licensee partially implements that program with Procedure DB-SP-00001 which required that performance test (PT 5164.04) be performed by August 4, 1988, and performance test (PT 5172.00) be performed by August 21, 1988.
Contrary to the above, the Radioactive Fluid Leak Reduction Program Outside Containment required by Technical Specification 6.8.4 was not implemented and maintained in that PT 5164.04 was not performed by

Technical Specification Limiting Condition for Operation 3.3.3.10 requires that the radioactive gaseous effluent monitoring instrumentation channels shown in Table 3.3-16 shall be operable i
with their alarm / trip setpoints set to ensure that the limits of Specification 3.11.2.1 are not exceeded.
Table 3.3-16 requires that a minimum of one channel of station vent stack monitoring instrumentation be operable for noble gas activity during radioactive waste gas releases via the station vent stack.
Technical Specification Limiting Condition for Operation 3.3.3.10, Action b requires that with less than the minimum number of radioactive gaseous effluent monitoring instrumentation channels operable, action shown in Table 3.3-16 be taken. Table 3.3-16 requires that with less than the minimum number of radioactive gaseous effluent monitoring j
instrumentation channels operable, action 27 be taken. Action 27 requires that if radioactive releases continue via the station vent stack grab samples be taken at least once per eight hours.
Contrary to the above, when less than the minimum number of station vent stack monitors were operable from August 2, 1988, until August 8, 1988, six radioactive gas releases were made via the station vent stack and no grab samples were taken.
This is a Severity Level IV violation (Supplement I).
